Stormwater Maintenance Agreement <br />A recorded Declaration for Maintenance of Stormwater Facilities between RCWD and Lennar <br />covers Ponds 100, 200, 300 and 20. These stormwater facilities and Pond 400 will be eventually <br />covered under the City's Programmatic Stormwater Management Agreement after they have <br />been installed and accepted by the City <br />A recorded stormwater declaration is required for the private facilities in the townhome area. The <br />current declarations include additional facilities that in the future will be covered by the City's <br />Programmatic agreement in the future. <br />RECOMMENDATION <br />Staff recommends approval of the Watermark 3rd Addition PUD Final Plan/Final Plat subject to <br />the following conditions: <br />1. The 3rd Addition Development Agreement shall be approved by the City Council, <br />executed and recorded against the property. <br />a. The Development Agreement will include park dedication credit for the platted <br />private parks, Outlot K and Outlot I, Watermark. <br />2. The title commitment shall be reviewed by the City Attorney prior to the release of the <br />final plat mylars. <br />3. The City Attorney shall review and approve the applicable Watermark Homeowner's <br />Association (HOA) documents prior to release of the final plat mylars. <br />a. All applicable HOA documents shall be amended to include the revised Open <br />Space Maintenance Plan. <br />4. A copy of the recorded deed for Outlot A shall be submitted to the City. <br />5. A copy of the recorded Permanent Trail Easement with Description Sketch for the trail on <br />Outlot A and Townhome Neighborhood shall be submitted to the City. <br />6. A separate fence permit is required for the fencing along CSAH 54 (201h Avenue). <br />The following comments shall also be addressed: <br />1. All comments from the City Engineer Letter dated March 4, 2020 shall be addressed. <br />2. All comments from Environmental Coordinator Memo dated March 4, 2020 shall be <br />addressed. <br />3. Draft copies of the applicable HOA documents shall be submitted to the City for review <br />and approval. <br />4. A draft copy of the deed for Outlot A shall be submitted to the City for review and <br />approval. <br />5. The Permanent Trail Easement with Description Sketch for the trail on Outlot A shall be <br />revised to include the trail section from the townhome neighborhood to the south lot line. <br />6. Watermark 3rd Addition Home Plans Booklet: <br />a. A summary table of the housing products and # lots shall be included. <br />7. Watermark 3rd Addition Landscape Plan Sheets: <br />a. The plans shall include landscaping and foundation planting details for townhome <br />
