b. Adjacent parcels of land shall not be separated by public right-of-way. <br />The three (3) parcels are not separated by public right-of-way. <br />(d) Up to double the animal unit density may be allowed subject to an approved <br />facility management and waste handling plan. <br />The maximum number of animal units allowed on the three (3) combined <br />parcels is 12.5. <br />With an approved facility management and waste handling plan, a maximum <br />of 25.0 animal units are allowed. <br />If PID# 05-31-22-22-0006 were to be sold and/or not remain under common <br />ownership, the maximum number of allowed animal units on the subject site <br />would be reduced to 21.0. <br />(e) Buildings housing domestic livestock, including barns, stables, sheds, and <br />similar facilities shall be located no nearer than 100 feet from any inhabited, <br />neighboring dwelling. <br />Barns, stables and sheds on the property are located more than 300 feet away <br />from the inhabited neighboring dwelling. <br />RECOMMENDATION <br />Staff offers the following three (3) options: <br />1. Approve a Conditional Use Permit for Commercial Stables to allow for a <br />maximum of 12.5 animal units. <br />a. A maximum of 12.5 animal units are allowed on the three (3) parcels <br />combined without a facility management and waste handling plan. <br />b. The Conditional Use Permit Council resolution shall be recorded against <br />all three (3) parcels. <br />c. The subject site shall be in compliance with all City and other regulatory <br />agencies requirements. <br />d. Compliance shall be required within one (1) year of the conditional use <br />permit (CUP) approval or the CUP may be revoked. <br />e. Future violations of the conditional use permit or other city, state or <br />regional ordinances may result in revocation of the conditional use permit. <br />f. No manure bins or manure storage shall be located in the wetlands or <br />floodplain. <br />g. No manure waste shall be stored or spread within 50 ft of a wetland. <br />i. A 50 ft wide vegetated wetland buffer shall be maintained. <br />h. The applicant shall provide documentation to the City that the septic <br />system and drain field on the subject site have been inspected and <br />12 <br />
