determined to be in compliance with state requirements and sized for <br />intended use. <br />i. Any future improvements required for restrooms shall be ADA compliant. <br />j. The number of portable animal shelters shall be limited to three (3). <br />k. The commercial stables are subject to Chapter 503, Animal Control <br />Regulations and shall be in compliance at all times. <br />1. PID #05-31-22-22-0003 and PID #05-31-22-22-0005 shall be combined <br />with Anoka County. <br />i. Proof of combination shall be submitted to the City. <br />ii. The newly combined parcel for the commercial stables shall be <br />addressed 450 Pine Street. <br />in. The commercial stable operations shall only occur on the newly combined <br />parcel addressed 450 Pine Street. <br />n. If in the event, PID #05-31-22-22-0006 (426 Pine Street -single family <br />house) is sold and no longer under common ownership, the maximum <br />number of animal units for the commercial stables shall be reduced to <br />10.5. <br />o. The 1986-Conditional Use Permit for Riding Stable/Show Arena and <br />1997: Conditional Use Permit for BMX Track/Arena shall be terminated. <br />i. City staff shall draft the Termination Agreements and shall be <br />recorded. <br />ii. Copies of the recorded Agreement shall be submitted to the City. <br />2. Approve Conditional Use Permit for Commercial Stables to allow for a maximum <br />of 26 animal units with a MPCA approved facility management and waste <br />handling plan. <br />a. A maximum of twenty-five (25) animal units are allowed between the <br />three (3) combined with a compliant facility management and waste <br />handling plan. <br />b. The applicant shall work with the MPCA in creating a feasible facility <br />management and waste handling plan. <br />i. The facility management and waste handling plan shall require off - <br />site storage of manure waste. <br />ii. A written and signed agreement with an off -site property owner <br />shall be submitted to the City annually. The agreement shall detail <br />the number of times manure waste will be removed from the site <br />and how much waste will be removed. <br />c. The Conditional Use Permit Council resolution shall be recorded against <br />all three (3) parcels. <br />d. The subject site shall be in compliance with all City and other regulatory <br />agencies requirements. <br />i. Compliance shall be required within one (1) year of the conditional <br />use permit (CUP) approval or the CUP may be revoked. <br />ii. Future violations of the conditional use permit or other city, state <br />or regional ordinances may result in revocation of the conditional <br />use permit. <br />13 <br />
