• <br />• <br />• <br />CITY OF LINO LAKES <br />RESOLUTION NO. 20-20 <br />APPROVING PRELIMINARY PLAT AND OPENING SUB -DISTRICT 3C & 3D OF <br />UTILITY STAGING AREA 2A (2020-2025) FOR NADEAU ACRES <br />WHEREAS, the City received a land use application for preliminary plat for Nadeau Acres <br />hereafter referred to as Development; and <br />WHEREAS, City staff has completed a review of the Development based on the following: <br />• Nadeau Acres Civil Plan Set prepared by Carlson McCain revision date March 20, 2020 <br />• Stormwater Management Plan prepared by Carlson McCain revision date March 20, 2020 <br />• Stormwater Pollution Prevention Plan prepared by Carlson McCain dated December 6, <br />2019 <br />• Geotechnical Exploration Report prepared by Haugo Geotechnical Services dated <br />December 6, 2019 <br />• Wetland Permit Application prepared by Kjolhaug Environmental Services Company <br />Inc. dated December 23, 2019 <br />• Rare Plant Report prepared by Midwest Natural Resources dated December 12, 2019 <br />• Traffic Impact Study by Spack Consulting dated December 6, 2019; and <br />WHEREAS, a public hearing was held before the Planning & Zoning Board on February 12, <br />2020 and the Board recommended approval of the Development with a 2-1; and <br />WHEREAS, 2030 Comprehensive Plan's Growth Management Policy requires the City Council <br />to determine by resolution if the next 10 year utility staging is to be opened to development; and <br />WHEREAS, the Development is located in Sanitary Sewer District 3 (Sub -District 3C and 3D) <br />of 2030 Utility Staging Area 2A (2020-2025). <br />NOW, THEREFORE BE IT RESOLVED by The City Council of The City of Lino Lakes <br />hereby makes the following: <br />FINDINGS OF FACT <br />Preliminary Plat <br />Per Section 1001.013, Premature Subdivision: <br />(1) General. Any concept plan, preliminary plat or final plat deemed premature pursuant to the <br />following criteria shall be denied by the City Council. <br />(2) Conditions for establishing a premature subdivision. A subdivision may be deemed <br />premature should any of the following conditions not be met. <br />(a) Consistency with the Comprehensive Plan. Including any of the following: <br />
