City of Lino Lakes - Zoning Ordinance <br />I* Subd. 2. Administration: Conditional Use Permits. <br />A. General Statement. Certain uses, while generally not suitable in a particular <br />zoning district, may under some circumstances be suitable. When such <br />circumstances exist, a conditional use permit may be granted. Conditions may <br />be applied to issuance of the permit and an annual review of the permit shall be <br />required. The permit shall be granted for a particular use and not for a particular <br />person or firm. Conditional use permits may be granted in accordance with this <br />subdivision for any use or purpose for which such permits are required or <br />permitted by this ordinance or as listed as a conditional use for the zoning <br />districts provided in Sections 5-9 of this ordinance. <br />B. Procedure. <br />1. The person applying for a conditional use permit shall fill out and <br />submit to the Zoning Administrator a "Zoning Form" together with a fee as <br />established by City Council resolution. The request for conditional use <br />permit shall be placed on the agenda of the first possible Planning and <br />Zoning Board meeting occurring thirty (30) days from the date of <br />submission of the application. The request shall be considered officially <br />submitted and the application approval time line commences when all the <br />• information requirements are complied with. <br />2. A public hearing on the conditional use permits shall be held by the <br />Planning and Zoning Board or the City Council. <br />3. At least ten(10) days prior to the public hearing; notice of the <br />purpose, time and place of such public hearing shall be published in the <br />official newspaper of the City and mailed to the property owners within <br />three hundred fifty (350) feet of the property in question. Failure of any <br />property owner to receive the mailed notification shall not invalidate the <br />proceedings. <br />4. The applicant or his representative must appear before the <br />Planning and Zoning Board in order to answer questions concerning the <br />proposed conditional use. <br />5. Site and building plans consistent with the requirements <br />established in Section 2, Subd. 5.B shall be provided prior to Planning <br />and Zoning Board review. <br />6. The Zoning <br />• persons to prepare <br />general assistance <br />City Council. <br />Administrator shall instruct the appropriate staff <br />technical reports where appropriate and provide <br />n preparing a recommendation of the action to the <br />2-4 <br />
