8 Homeowner’s Association (HOA) The City Attorney is reviewing the submitted HOA documents. Any comments shall be addressed prior to release of the mylars. Title Commitment The City Attorney is reviewing the title commitment and final plat. Any comments shall be addressed prior to release of the mylars. Stormwater Maintenance Agreement The stormwater facilities will be covered under the City’s Programmatic Stormwater Management Agreement after they have been installed and accepted by the City. RECOMMENDATION Staff recommends approval of the Watermark 4th Addition PUD Final Plan/Final P lat subject to the following conditions: 1. The 4th Addition Development Agreement shall be approved by the City Council, executed and recorded against the property. 2. The City Attorney shall review the title commitment prior to the release of the final plat mylars. 3. The City At torney shall review the Homeowner’s Association (HOA) documents prior to release of the final plat mylars. 4. A copy of the recorded Homeowner’s Association documents shall be submitted to the City prior to issuance of building permits. 5. A copy of the recorded deed for Outlot C shall be submitted to the City. 6. Per the Watermark 3rd Addition Development Agreement, the townhome tot lot, play equipment and associated landscaping on Outlot I, Watermark shall be completed by August 30, 2021. The following comments shall also be addressed: 1. All comments from the City Engineer Letter dated January 7, 2021 shall be addressed. 2. All comments from Environmental Coordinator Memo dated January 7, 2021 shall be addressed. 3. A draft copy of the deed for Outlot C shall be submitted to the City for review and approval. 4. Watermark 4th Addition Landscape Plan Sheets: a. The plans shall include the Main Entrance Monument and Entrance Monument signs.
