Declaration of Access Control <br /> The Declaration of Access Control shall be revised as noted below and submitted to the <br /> City for final review and approval prior to recording. <br /> Findings of Fact-Final Plat <br /> The Planning and Zoning Board shall consider the final plat and the Community <br /> Development Department shall forward the Planning and Zoning Board <br /> recommendations to the City Council. The following requirements shall be met before <br /> consideration of the final plat by the Planning and Zoning Board: <br /> 1. The final plat shall substantially conform to the approved preliminary plat and <br /> phasing plan. <br /> The final plat substantially conforms with the revised preliminary plat. <br /> 2. For plats that consist solely of individual single family residential lots, final plat <br /> applications for subsequent phases shall not be approved until building permits <br /> have been issued for 40% of lots in the preceding phase. This division applies <br /> only when the preceding phase consists of 40 or more lots; and <br /> Not applicable. The final plat is for a commercial development. <br /> 3. Conditions attached to approval of the preliminary plat shall be substantially <br /> fulfilled or secured by the development agreement, as appropriate. <br /> The conditions of the preliminary plat have been substantially fulfilled. Outstanding <br /> conditions listed below need to be addressed prior to release of the final plat mylars. <br /> Securities will be required with a Development Agreement. <br /> RECOMMENDATION <br /> Staff recommends approval of the Otter Crossing final plat with the following conditions: <br /> 1. The private road and sidewalk will be privately owned and maintained as detailed <br /> in the Declaration of Driveway Easement. <br /> 2. The stormwater facilities (e.g. stormwater pond and pipe)will be privately owned <br /> and maintained as detailed in the Declaration for Maintenance of Stormwater and <br /> Declaration of Driveway Easement. <br /> 3. The municipal watermain, sanitary sewer and trail will be publicly owned and <br /> maintained. <br /> 4. A comprehensive sign plan for the entire building is required for multi-occupancy <br /> business buildings. <br /> 5. Any retail space proposed for any use other than retail (i.e. restaurant) shall meet <br /> the City's parking ordinance requirements. <br /> 14 <br />
