1. The final plat substantially conforms to the approved preliminary plat subject to the <br /> conditions listed below. <br /> 2. The City Attorney reviewed the status of title/property ownership related to the <br /> final plat and notes the title commitment shall be updated. <br /> 3. A 4th Addition Development Agreement has been drafted and shall be executed. <br /> 4. Conditions attached to approval of the preliminary plat have been fulfilled or <br /> secured by the Development Agreement. <br /> 5. All fees, charges and escrow related to the preliminary or final plat have been paid <br /> in full. <br /> BE IT FURTHER RESOLVED by the City Council of the City of Lino Lakes hereby <br /> approves Watermark 4th Addition PUD Final Plan/Final Plat subject to the following <br /> conditions: <br /> 1. Outlots A, B and D, Watermark 4th Addition are preserved as permanent Open <br /> Space and shall be improved by the Developer in accordance with the approved <br /> plans and upon completion and acceptance by the city of such improvements,they <br /> shall be owned and maintained by a Homeowner's Association in accordance <br /> with an approved Restoration and Management Plan. <br /> 2. Outlot C, Watermark 4th Addition shall be deeded to the City as a Public Park. <br /> 3. The Developer shall obtain a FEMA approved CLOMR to revise the impacted <br /> floodplain prior to the City issuing a grading permit. Building permits will not be <br /> issued on until a FEMA approved LOMR is received for Lots 12-20 Block 1, Lots <br /> 8-18 and 20-26 Block 2, and Lots 1-2 Block 3 of the Watermark 4th Addition. <br /> 4. Per the Watermark 3rd Addition Development Agreement,the townhome tot lot, <br /> play equipment and associated landscaping on Outlot I, Watermark shall be <br /> completed by August 30, 2021. <br /> BE IT FURTHER RESOLVED by the City Council of the City of Lino Lakes hereby <br /> approves the Development subject to the following items being addressed prior to release <br /> of final plat mylars: <br /> 1. The 4th Addition Agreements (Development Agreement, City Park Operations <br /> and Maintenance and Stormwater Re-Use Agreement and Stormwater Re-Use <br /> Agreement) shall be approved by the City Council, executed and recorded against <br /> the property. <br /> 2. Any staff comments requiring revisions to the final plat shall be addressed. <br /> 3. The title commitment shall be updated. <br /> 4. A draft copy of an Open Space Easement covering the following outlots shall be <br /> submitted to the City for review and approval: <br /> a. Outlots G, J,M and N,Watermark <br /> b. Outlot A, Watermark 2nd Addition <br /> c. Outlot A,Watermark 3rd Addition <br /> d. Outlots A,B and D,Watermark 4th Addition <br /> 5. A draft copy of the deed for Outlot C, Watermark 4th Addition shall be submitted <br /> to the City for review and approval. <br /> 2 <br />
