MEMORANDUM
TO: All Park Board Members
FROM: Marty Asleson
DATE: October 30, 1992
SUBJECT: Living Waters Lutheran Church Proposal
Please find attached a copy of the proposal for Park Trail
Dedication from Living Waters Lutheran Church. This subdivision is
on the northwest side of the "S" curve on Birch Street. (Please see
the accompanying sketch map with statistical information) . Our park
dedication ordinance for subdivisions addresses residential,
commercial and industrial requirements. This subdivision is zoned
r R-1 (single family residential) with a conditional use.
I consulted with Bob Kirmis of Northwest Consultants (the city
planning consultants) to give me an opinion on this issue. As it
points out, there are no exclusionary clauses to the subdivision
ordinance. Our park dedication ordinance does not however,
necessarily include churches for requirements. Bob points out that
the park board should consider amending the ordinance to reference
this.
We have completed a sampling phone survey of other cities and how
they treat this issue. Please refer to the attached memo from
Carole Kohler. I believe that the church proposal has merit and
follows our comprehensive plan. Note that there was no dedication
taken for other churches in the city. However, for example,
Gethsemene Methodist Church owned the parcel that they built on, so
there was no subdivision.
Please give me a call if you have further questions.
