The <br /> Park and Recreation Commission shall , in each case, recommend to <br /> the City Council the total area and location of such land that the <br /> Commission feels should be so conveyed or dedicated within the <br /> development for park, playground, open space and public use <br /> purposes . <br /> 9 .07 . 5 Cash Contribution in Lieu of Lands . In those <br /> instances where a cash contribution is to be made by the owners or <br /> developers in lieu of a conveyance or dedication of land for park, <br /> playground, open space or public use purposes, the Park and <br /> Recreation Commission shall recommend to the City Council the <br /> amount of cash said Commission feels should be so contributed. <br /> Such recommendation shall be based on the market value of the <br /> undeveloped land that would otherwise have been conveyed or <br /> dedicated. <br /> 9 . 07 .6 Market Value of Lands. "Market Value" , for the <br /> purposes of this Ordinance shall be determined as of the time of <br /> the final plat without improvements in accordance with the <br /> following: <br /> a. The Park and Recreation Commission and owners or <br /> developers may recommend as to market value. <br /> b. The City Council , after reviewing the Park and Recreation <br /> r-� Commission' s recommendation, may agree with the owner or <br /> developer as to the market value. if agreement is not <br /> reached in this manner, then the market value shall be <br /> determined by an accredited appraiser chosen by the Park <br /> and Recreation Commission, at the expense of the owner or <br /> developer. Such appraisal shall be accepted by the City <br /> Council and the owner or developer as being an accurate <br /> appraisal of "market value" . ( 10N, 3-07-89 ) <br /> 9 .07 .7 Density and Open Space Requirements. Land area so <br /> conveyed or dedicated for park, open space and playground purposes <br /> may not be used by an owner or developer as an allowance for <br /> purposes of calculating the density requirements of the <br /> development as set out in the City Zoning Ordinance. The land <br /> shall be in addition to, (except for 9 . 07 .8 ) , and not in lieu of, <br /> open space requirements for Planned Unit Developments pursuant to <br /> the City Zoning Ordinance. <br /> 9 . 07 .8 Credit for Private Open Space. Where private open <br /> space for park and recreation purposes is provided in a proposed <br /> non-residential development and such space is to be privately <br /> owned and maintained by the owner of that non-residential <br /> development, such areas may be used for credit at the discretion <br /> of the City Council against the requirement of dedication for park <br /> and recreation purposes, provided the City Council finds it is in <br /> the public interest to do so and that the following standards are <br /> �0'*N <br /> met: <br /> Page 1 . <br />
