That yards, court areas, setbacks and open space required <br /> to be maintained by City Ordinances shall not be included <br /> in the computation of such private open space; <br /> b. That the private ownership and maintenance of the open <br /> space is adequately provided for by written agreement; <br /> c. That the private open space is restricted for park and <br /> recreation purpose by recorded covenants which run with <br /> the land in favor of the owners of the property within the <br /> non-residential development and which cannot be eliminated <br /> without the consent of the City council ; <br /> d. That the proposed private open space is reasonably <br /> adaptable for use for park and recreational purposes, <br /> taking into consideration such factors as size, shape, <br /> topography, geology, access and location of the private <br /> open space; <br /> e . That facilities proposed for the open space are in <br /> substantial accordance with the provisions of the <br /> recreational element of the Comprehensive Plan, and are <br /> approved by the City Council and; <br /> f. That where such credit is granted, the amount of credit <br /> shall not exceed one hundred ( 100% ) percent for the non- <br /> residential development of the amount calculated under <br /> Section 9. 07 . 10 . <br /> 9 . 07 .9 Park and Recreation Commission Administrative <br /> Procedures. The Park and Recreation Commission shall establish <br /> such administrative procedures as they may deem necessary and <br /> required to implement the provisions of this Ordinance . <br /> 9 . 07 .10 Dedicated Land, Minimum Area. Developers of land <br /> within the City of Andover shall be required to dedicate to the <br /> City for park, open space and playground purposes as a minimum <br /> that percentage of gross land area as set out below: <br /> a. Residential Requirement <br /> Dwelling Units/Acre <br /> (Gross Density) <br /> 0 - 3 10% <br /> over 3 Add two ( 2% ) percent to <br /> dedication requirements <br /> for each additional <br /> dwelling unit over three <br /> ( 3 ) units per gross <br /> density. <br /> b.
