/1 <br /> PLANNING & ZONING BOARD MAY 13, 1992 <br /> IV. DISCUSSION ITEMS <br /> A. 7080 Lake Drive - Planning Consultant Al Brixius reviewed this <br /> items which involves property on Lake Avenue Zoned GB and <br /> containing a single family residence in good repair. The property <br /> is for sale and a potential buyer would like to operate a small <br /> business out of the accessory building located on the property. <br /> According to the Zoning Ordinance, the business is a permitted use <br /> but the single family residence is not, and the Ordinance does not <br /> have any provision for this type of situation. Staff is asking the <br /> Planning Board for direction in this matter as there are other <br /> properties within the City in similar circumstances. Mr. Brixius <br /> provided the Planning Board with an example of an "Interim Use <br /> Permit" and the State Legislation creating such a vehicle for the <br /> Boards review. The Interim Use Permit would allow a use similar to <br /> that mentioned and provide an expiration date allowing the property <br /> to be brought into total conformance with the Zoning Ordinance at <br /> a future date. The purpose is to encourage and promote business, <br /> allow use of the single family home and provide for an orderly <br /> transition to a total business use. <br /> The Planning Board had several questions regarding the site and the <br /> use of an Interim Use Permit. Tom Mesich asked if we could issue <br /> a CUP for this use and was advised that the Interim Use Permit <br /> would be the best tool to use. James Schaps asked what could be <br /> done in the next 30 days regarding this item. City Engineer <br /> Schneider stated that we could take the matter to the City Council <br /> Work Session and ask them for direction. The Planning Board <br /> concurred with this suggested and also indicated that they would be <br /> willing to hold a special meeting to review the matter if <br /> necessary. <br /> B. Apitz Garage, Birch Street - Rocky Goertz was present <br /> representing Apitz Garage. He explained they are proposing a 576 <br /> square foot addition to their building and have letters from three <br /> adjoining property owners indicating no objections. He asked the <br /> Planning Board if they could possibly waive the public hearing as <br /> there are not objections to the request and construction time is <br /> short. The Board advised him that he would have to go through the <br /> public hearing process as this is an Amended Conditional Use <br /> Permit. Tom Mesich moved and was seconded by Monika Slatten to <br /> schedule the public hearing for June 10, 1992 . All voted aye. <br /> Motion carried. <br /> C. Comprehensive Plan - Planning Consultant Brixius reviewed three <br /> Comprehensive Plan Amendments involving the Sewer Plan, Land Use <br /> Plan, and MUSA Expansion. He explained that these amendments have <br /> been reviewed and approved by the Metro Council but not officially <br /> adopted by the City Council. Mr. Brixius' reports are on file and <br />
