ED VAUGHAN`S COMMITTMENT <br /> A. ED VAUGHAN DONATES SHERMAN LAKE AND WARD LAKE PLUS 30 FEET OF <br /> LAND SURROUNDING THE NORMAL LEVEL OF LAKE BOUNDARY TO THE CITY <br /> OF LINO LAKES. <br /> B. ED VAUGHAN RECEIVES PARK DEDICATION CREDIT FOR THE "ISLAND" PLUS <br /> THE BALANCE OF PHEASANT HILLS PRESERVE. THE SCHOOL PROPERTY <br /> ADJOINING PHEASANT HILLS PRESERVE WAS INCLUDED IN THE ORIGINAL <br /> PARK DEDICATION AGREEMENT WITH THE CITY AND WOULD CONTINUE TO BE <br /> COVERED UNDER THE NEW AGREEMENT. <br /> II. THE COMMITTMENT OF THE CITY OF LINO LAKES. <br /> A. LINO LAKES AGREES TO THE FOLLOWING: <br /> 1. RELINQUISH ANY CLAIM TO THE "ISLAND". <br /> 2. ACCEPTS THE LAND AS STATED ABOVE AS PARK DEDICATION FOR THE <br /> SCHOOL PROPERTY, PHEASANT HILLS PRESERVE PLUS THE "ISLAND". <br /> 3. AGREES TO GET A PERMIT FROM THE DNR FOR A CROSSING TO THE <br /> "ISLAND" FROM THE LAND OWNED BY EEV LOCATED NORTH OF THE <br /> WEAVER/HOKANSON PROPERTY. THIS ACCESS MUST BE VEHICULAR ACCESS. <br /> 4. ABANDON CITY TRAIL ACCESS ACROSS THE "ISLAND" AS WELL AS THE <br /> LAND NORTH OF THE WEAVER PROPERTY. <br /> 5. LEVY NO FEES FOR SEWER AND WATER SERVICE (AREA OR CONNECTION) <br /> FOR ANY LOTS DEVELOPED ON THE "ISLAND". <br /> 6. NO CITY TIME WILL BE CHARGED AGAINST PHP FOR THIS LAND SWAP. <br /> B. LINO LAKES WILL BE FINANCIALLY RESPONSIBLE FOR THE COSTS INCURRED <br /> IN THE LAND TRANSFER AND FILING FEES FOR THE LAKES TO ANOKA PARKS. <br /> III. FACTS TO BE CONSIDERED. <br /> A. THE 30 ACRES THAT THE CITY OF LINO LAKES WILL RECEIVE FROM THE <br /> ANOKA COUNTY PARKS IS WORTH NO LESS THAN $10,000 PER ACRE. <br /> B. THE TOTAL PARK DEDICATION FEE THAT IS BEING WAIVED FOR PHEASANT <br /> HILLS PRESERVE PLUS THE SCHOOL PROPERTY @ $500 PER LOT TOTALS <br /> $130,000. <br /> C. THE VALUE OF THE 30 ACRES EXCEEDS THAT OF THE "ISLAND" BY A <br /> CONSIDERABLE AMOUNT. <br /> D. THE REASON FOR NOT GIVING ADDITIONAL LAND AROUND THE LAKES IS <br /> PREDICATED ON THE POSSIBILITY THAT IS MIGHT BE NECESSARY TO SELL <br /> OFF 10 ACRE PARCELS AROUND THE "ISLAND". <br /> E. BY LIMITING THE AREA DONATED AROUND SHERMAN LAKE THERE WILL BE NO <br /> CONFLICTS ABOUT MY MITIGATION WITH THE CORP OF ENGINEERS OR THE <br /> LAND TRADED TO THE PARK. <br /> ,.,F.
