STATE OF AGENDA ITEM 4 C
UHMZ(0)uQ
^ DEPARTMENT OF NATURAL RESOURCES
METRO WATERS, 1200 Warner Road, St. Paul, MN 55106
PHONE NO. 772-7910 FILE NO.
November 25, 1992
Mr. Marty Asleson
City of Lino Lakes
1189 Main Street
Lino Lakes, Minnesota 55014
RE: PERMIT APPLICATION 93-6042 , BRANDYWOOD PARK, TRAIL CROSSING OF
PROTECTED WETLAND 2-255W, CITY OF LINO LAKES, ANOKA COUNTY
Dear Mr. Asleson:
In reviewing the above referenced permit application, some concerns
have surfaced regarding your consideration of alternatives to
wetland fill for the trail. Your application does not include
alternatives, or rational for why your proposed design is the only
feasible alternative. I have enclosed a copy of Minnesota Rules
pertaining to the filling in of protected waters of the state of
Minnesota. Please note part 6115.0191, subpart 3. , item F.
Specifically, Minnesota Rules state that:
1. There must be no other feasible or practical alternative to
the project which would have less impact.
2 . That the public need for the project rules out the no-build
alternative.
I understand that the trail must be designed for handicap
accessibility. I believe though, that bridges, arches and
boardwalks can be designed to accomodate these needs. Please call
me if you need examples.
If you have additional information which you believe should be
considered in the review of your permit, or alternate design
proposals, please submit them for our review. Please respond by
December 20, 1992. If I receive no response, a limited permit will
be issued authorizing a crossing that involves no fill.
If you have any questions please feel free to call Tony DeMars or
myself at 772-7910.
Sincerely,
1-11-4
Tom Hoveyy
Area Hydrologist
Enclosure
AN EQUAL OPPORTUNITY EMPLOYER
