METRO WATERS, 1200 Warner Road, St. Paul, MN 5 pig <br /> 772-7910 <br /> January 7, 1993 <br /> Mr. Marty Asleson <br /> City of Lino Lakes <br /> 1189 Main Street <br /> Lino Lakes, Minnesota 55014 <br /> RE: LIMITED PERMIT #93-6042 , PUBLIC WATERS WETLAND 2-555W, CITY OF <br /> LINO LAKES, ANOKA COUNTY <br /> Dear Mr. Asleson: <br /> Enclosed is Limited Permit #93-6042 authorizing the construction of <br /> two boardwalk wetland crossings at the west end of DNR Public <br /> Waters Wetland 2-555W, and within the Brandywood Park development. <br /> ,.� This is a modification of your proposal for placing fill for two 15 <br /> foot wide wetland crossings. <br /> Minnesota Rules, part 6115.0190, subpart 1, states that it is the <br /> goal of the Department to limit the placement of any fill material <br /> into protected waters in order to "minimize encroachment, change, <br /> or damage to the environment". Subpart 3 of the same rule states <br /> that filling is prohibited to construct a roadway or pathway unless <br /> there is "no other feasible or practical alternative to the project <br /> that would have less environmental impact" . <br /> In evaluating your permit request, we have determined that there is <br /> other feasible and practical alternatives to the project that would <br /> have less environmental impact. DNR staff has further determined <br /> that a trail access across the wetland at the requested locations <br /> can be accomplished with less environmental impact by the use of a <br /> structural boardwalk. - <br /> Pursuant to Minnesota Statutes,< Section 103G. 311, Subd. 5, the <br /> applicant, the managers of the watershed district, the board of <br /> supervisors of the soil and water conservation district or the <br /> mayor of the city may demand a hearing on the Order provided the <br /> demand for hearing and the bond required by Subd. 6 be filed with <br /> the Commissioner within 30 days. No bond or security is required <br /> of a public authority which demands a hearing. The Statutes <br /> further provide that if no demand for hearing be made or if a <br /> •� hearing is demanded but no bond is filed as required by Subd. 6, <br /> the Order shall become final at the expiration of 30 days after <br /> mailed notice thereof and no appeal of the Order may be taken to <br /> the Minnesota State Court of Appeals. <br /> AN EQUAL OPPORTUNITY EMPLOYER <br />
