AGENDA ITEM - 4 �1 <br /> MEMORANDUM <br /> TO: Lino Lakes Park Board <br /> FROM: Marty Asleson <br /> DATE: January 25, 1993 <br /> SUBJECT: Shores of Marshan Lake Trail Issue <br /> Please find a copy of a letter of the Shores of Marshan Lake trail <br /> issue that was sent to the planning and Zoning Board meeting on <br /> December 8, 1992 . Subsequently, the developer submitted letters to <br /> the Army Corps of Engineers applying for permits to have parts of <br /> the trail relocated. We have no further information on the <br /> progress of this permit at this time. <br /> We have been directed as staff to spend no more time on this issue, <br /> ^ and that the City Council may consider trail relocation if the <br /> developer has the permits approved. The City Council does not want <br /> to consider a trail/sidewalk situation. <br /> It is unfortunate that the developer took lightly the new wetland <br /> laws that have placed restrictions on wetland encroachment. It is <br /> also unfortunate that the consideration for minor encroachment, <br /> particularly when there is a proven social need, is not considered. <br /> Please see my correspondence with the Department of Natural <br /> Resources on the Brandywood trail issue. It appears that in this <br /> case we were all a little unprepared for the new changes. Our <br /> comprehensive plan addresses the need to avoid the wetlands. In <br /> order to do this completely bill greatly increasesour trail costs. <br /> �t <br /> We had a period of time to appeal the Brandywood trail permit. It <br /> appears that another city has appealed a similar situation. We <br /> have been informed that if they win their appeal then we most <br /> likely will win the Brandywood trail request. <br /> The solution to all of this is that in the future, there will be no <br /> final plat approvals without wetland permits approved. I also <br /> believe that we should be using our parks planning consultant to <br /> verify wetland boundaries and trail placement, and design quality <br /> control. <br />
