AGENDA ITEM 4 A. <br /> MEMORANDUM <br /> TO: Planning and Zoning Board <br /> FROM: Marty Asleson, Parks and Recreation Coordinator <br /> Don Volk, Public Works Director <br /> Darrell Schneider, City Engineer <br /> DATE: December 8, 1992 <br /> SUBJECT: The Trail in The Shores Of Marshan Lake <br /> Please find attached the staff report to the December Park Board <br /> and the Park Board minutes relating to the trail issue in the <br /> Shores of Marshan Lake Development. As you recall, this trail was <br /> approved by the City Council as part of the final plat approval. <br /> The developer had originally conceptually placed the trail <br /> alignment in Corps controlled wetland. The developer failed to <br /> secure the appropriate written approval from the Army Corps of <br /> Engineers, so in order to keep their plat going they submitted the <br /> plan for final plat approval with the trail in its presently <br /> located position. In its present position the developer needed no <br /> approval because it was located out of the wetlands. The City <br /> Council brought up the fact that the trail was close to the planned <br /> housing in some instances , and asked them if they had any concerns <br /> about this. The developer made it clear that he was requesting that <br /> the alignment shown be approved. The developer returned to the <br /> November park board under open-mike to attempt to "renegotiate" <br /> this trail alignment up on the street or some sidewalk scenario. <br /> Since this was not on the agenda for renegotiation (the plat had <br /> been approved) the Park Board could not act on this issue. <br /> Staff subsequently met with Mr. Menkveld and Mr. Kolstad to attempt <br /> to develop a plan of action since it may not be in the best <br /> interest of the city to have the trail so close to the backside of <br /> houses (about 40 ft. from the prpsently staked wetland boundry in <br /> the case of the existing model home) . <br /> The plan is outlined in the staff report to the park board. The <br /> overall objective of this plan is to maintain the continuity and <br /> integrity of the linear trail corridor concept. In particular we <br /> wish to keep as our objective the idea of an uninterrupted <br /> recreational experience vs. a segmented trail that is not <br /> consistent with our comprehensive plan. It was discussed that in <br /> order to expedite the trail permits and the trail layout and <br /> design, the city would obtain a budget figure to layout, design, <br /> and apply for permits to install the trail in the preferred <br />
