XI. ROADWAYS <br /> n The property has approximately 1,300 feet of frontage on Birch Street <br /> which is designated as a collector. This connection should be <br /> 'adequate to support the number of lots proposed. Adequate connections <br /> to adjacent land have been provided. <br /> The layout should be reviewed by the Public Works Director in terms of <br /> maintenance considerations. <br /> PROFESSIONAL OPINION <br /> It is our professional opinion that this proposal is consistant with <br /> the proposed Comprehensive Plan updates and should be approved at the <br /> appropriate time. <br /> The City Engineer and Building Official should review the soils report <br /> prior to the construction of any improvements. <br /> The feasibility studies for sanitary sewer and water services should <br /> be approved prior to, and as a condition to, the approval of this <br /> plat. <br /> A parkland dedication of 3-5 acres for a neighborhood park should be <br /> required. <br /> This proposal seems to make good planning sense conceptually, but we <br /> are concerned about their timing as it relates to the required process <br /> for amending the Comprehensive Plan. We have reviewed the situation <br /> and timing with the developer and he has agreed to wait for the <br /> March-April public hearing date. He can proceed, at his own risk, to <br /> discuss his plans and refine his designs based on the City's comments. <br /> Our overriding concern is the various potentials for liability <br /> exposure the City might have if approvals or guarantees, implied or <br /> official , were given and for some reason the plans were not adopted by <br /> the City. The City has certain timing, quality, and procedural <br /> requirements which should not be compromised. We hope the <br /> Comprehensive Plan amendments, re-zoning, and preliminary plats can be <br /> completed in order and with minimal delay to any development proposal , <br /> but do strongly encourage the City to not shortcut the process. <br /> We recommend this application be tabled until the above mentioned <br /> process can be completed. If the City feels it is necessary to <br /> immediately act on the application, and a denial is passed due simply <br /> to a timing or procedural matter, we should point out that Section 5, <br /> Subd. 3(9) of your Zoning Ordinance states: <br /> "No application for rezoning which has been denied shall be <br /> resubmitted for a period of twelve (12) months from the date <br /> of said order of denial unless all reasons for denial , as <br /> ,.� outlined by the City Council , have been satisfied." <br />
