r �• <br /> ORDINANCE NO. 21B <br /> VILLAGE OF LINO LAKES <br /> ANOKA COUNTY, MINNESOTA <br /> AN ORDINANCE AMENDING ORDINANCE NO. 21 , PASSED BY THE VILLAGE COUNCIL OF THE VILLAGE <br /> OF LINO LAKES;. ANOKA COUNTY, MINNESOTA, ON OCTOVER 14, 1957. <br /> The Village Council of the Village of Lino Lakes, Anoka County, Minnesota, ordains: <br /> Ordinance No. 21 , passed by the Village Council of Lino Lakes, Anoka County, Minn- <br /> esota, on October 14, 1957, is• hereby amended by adding thereto the following, to-wit: <br /> SECTION 16 A. PARK AND RECREATION <br /> It is deemed necessary and consistent with the Village Planning of the Village of <br /> Lino Lakes, Minnesota, to provide in each new proposed plat or subdivision areas for <br /> future development, for park and recreational purposes. Therefore, with each plat there <br /> shall hereafter be dedicated to the municipality an area equal to, not le-s than, but <br /> not to exceed, 10 per cent of the total proposed area to be subdivided less such area <br /> dedicated therein for public streets. Such area shall consist of developable and us- <br /> able land and shall be located so as to serve the present and future needs of the comm- <br /> unity for recreational and park purposes. The Planning Board and Village Council shall <br /> consider the proposed location in relation to existing or contemplated recreational and <br /> park sites in other parts of the community and as to the suitability in meeting the <br /> requirements of the Village Plan. Dedication of land for school or other public purposes <br /> ,..or for private recreational sites shall not satisfy the requirements of this section. <br /> The requirements of this section may be waived or modified by the Village.Council , <br /> after recommendation by the Planning Board, for any of the following reasons: <br /> I . The enforcement of this provision would act as an extreme hardship to the sub- <br /> divider because of the size of the tract involved. <br /> 2. Where the subdivider is enlarging a subdivision and has already dedicated land <br /> for park purposes and another park would not be beneficial to the area. <br /> As an alternative to the sections above, the subdivider may be allowed to contri- <br /> bute an amount in cash equivalent to the market value, on the date of the acceptance <br /> of the plat by the Village Council , of land required to be dedicated by this subdivision. <br /> The Village Council shall render the decision in all cases where there is a request <br /> to so contribute monies instead of dedication of lands, both as to whether such con- <br /> tribution shall be allowed in lieu of dedication and the amount of such contribution <br /> if a contribution is allowed. Such cash payments shall be turned over to the Village <br /> Treasurer for deposit in the Park Fund as dedicated funds. <br /> II <br /> Save as above amended, said Ordinance No. 21 shall stand as initially adopted and <br /> as previously amended. <br /> III <br /> This ordinance shall be in full force and effect from and after its passage and <br /> publication according to law. <br />
