11L`O1/96 FRI 16:14 FA-X 612 452 5550 C K S & F 444 BtRNSVILLE U002 <br /> GROUND LEASE <br /> GROUND LEASE dated , 1996, by and between the CITY <br /> OF BURNSVILLE, a Minnesota municipal corporation located at 100 Civic Center Parkway, <br /> Burnsville, MN 55337 ("Landlord"), and BURNSVYLLE SKATE PARK, INC., a Minnesota <br /> non-profit corporation ("Tenant"). <br /> 1. GRANT OF LEASE. In consideration of the mutual covenants and agreements <br /> hereinafter set forth, the Landlord does hereby Lease to Tenant and the Tenant does hereby rent <br /> from the Landlord the land described in the attached Exhibit "A." ("Property"). <br /> 2. TERM. This Lease shall commence on the 1st day of June, 1996, and shall <br /> terminate on the Ist day of June, 1999, unless sooner terminated in accordance with the other <br /> terms of this Lease. The Landlord may terminate this Lease on January 1st each year during the <br /> term of the Lease by giving Tenant sixty (60) days advance written notice. <br /> 3. RENT. Tenant agrees to pay Landlord an annual rental of One Dollar ($1.00). <br /> Rent shall be remitted to Landlord by check, in advance, on or before the 1st day of March <br /> during each year during the term of this Lease. <br /> 4. CONSTRUCTION OFDdPROVEMENTS. Tenant agrees to construct an inline <br /> skating, skateboarding and bicycling facility("Skate Park"), at its own expense, on the Property <br /> in accordance with the plans to be approved by the City Engineer. The Skate Park must be <br /> enclosed with an eight foot high (minimum) security fence which must be locked during non- <br /> operational hours. Any plan changes must be approved in writing by the Landlord. The plans <br /> must also be reviewed and approved, at Tenant's expense, by a structural engineer registered <br /> with the State of Minnesota.
