11/.'01/96 FRI 16:14 FAX 612 452 5550 C K S & F BURNSVILLE Q 003 <br /> the Skate Park structure must be inspected by the structural engineer and a letter submitted to <br /> the City from the engineer certifying that the facilities were constructed in accordance with the <br /> approved plans. If the Skate Park is not complete and ready for occupancy by the 1st day of <br /> September, 1997, the Landlord may cancel this Lease. <br /> 5. LIEN'S BY TENANT. <br /> 5.01 The Tenant shall not create or allow any liens for labor or material on the <br /> Property, and all persons contracting with the Tenant for the erection, installation, alteration, <br /> or repair of any building or other improvements on the Property, and all materialmen, <br /> contractors, mechanics, and laborers, are hereby charged with notic:; :hat they must look to the <br /> Tenant and to the Tenant's interests only in the Property to secure the payment of any bill for <br /> work done or material furnished during the term of this Lease. <br /> ,.� 5.02 Tenant agrees not to enter into any contract with any person, firm, or <br /> corporation, or with any labor contractor for labor, service, or material in connection with any <br /> building or improvement to be placed on the Property or to be rebuilt thereon unless it shall be <br /> stipulated in and be a condition of such contract that no lien shall arise or be claimed on account <br /> of such contract or on account of any work done or material furnished under the contract. <br /> 5.03 Tenant agrees to provide evidence to Landlord that Tenant has raised <br /> sufficient funds to make all of the improvements in the Plans needed to provide a safe and secure <br /> facility prior to beginning construction. <br /> S. USE. The Property shall only be used for the Skate Park and uses incidental to <br /> that use. <br /> 7. COVENANT, REPRESENTATION, AND WARRANTIES.
