111.01/96 FRI 16:15 FAX 612 452 5550 C K S & F BURNSy ILLE U 004 will be designed, constructed and maintained in accordance with the highest accepted standards of design construction and maintenance, and meet all applicable rules, regulations and codes at the time that the improvements are made and during the term of this Tease; (ii) the Skate Park will be supervised during all hours of operation by an adult; (iii)all persons using the Skate Park (or, if a minor, their parents or legal guardian) shall sign a waiver of liability and an agreement to hold harmless Tenant and Landlord; (iv) all waivers will be held by Tenant during the terms of this Lease and Tenant shall forward to Landlord monthly, a list of all participants at the Skate Park along with all waivers signed by the applicable participant; (v) all participants shall be required to wear appropriate safety equipment including, but not limited to helmets, hand, elbow and knee pads and appropriate footwear; (vi) signs will be posted at the entrance and such other places as are deemed appropriate, which state the Skate Park rules and regulations. All supervisors, employees and attendants at the Skate Park shall have first aid training and appropriate first aid supplies and materials shall be kept on the Property. A telephone shall be located at the Property for emergency use only. $. HOURS OF OPERATION. The Skate Park shall be open from May 1st through September 30th of each year during the following times: May: 2:00 P.M. - 9:00 P.M. June - August: 9:00 A.M. - 9:00 P.M. September: 2:00 P.M. - 9:00 P.M. The Landlord may require closure of the facility from time to time during community events. 9. ASSIGNMENT AND SUBLETTING. During the term of this Lease, Tenant may not, without the express written consent of Landlord, assign this Lease or any interest herein, or sublease all or any part of the Property. 34397.03 RNK:r11/01/96 3
