7. <br /> Lino Lakes Parks and Recreation Department <br /> 7204 Lake Drive <br /> C I ITY, <br /> eKd- <br /> O F Lino Lakes, MN 55014 <br /> E (612) 780-1885 Fax (612) 784-7227 <br /> April28, 1998 <br /> TO: Park Board Members <br /> FROM: Rick DeGardner, Parks and Recreation Director <br /> SUBJECT: Wenzel Farms Trails <br /> Staff has been in discussions with the Wenzel Farms Townhome Association to address the trail <br /> issues in the Wenzel Farms Development. <br /> The primary concern with the association was the potential liability having a trail easement on <br /> n their private road. Staff looked at possible alternatives regarding the trail segment that is <br /> currently located on Ivy Ridge Court/Ivy Ridge Lane. One option was to vacate the current trail <br /> easement on the private road and relocate the trail on the County right-of-way along Lake Drive. <br /> Another option was to create a separate pathway along Ivy Ridge Court/Ivy Ridge Lane. Both <br /> these options were not feasible. The association has requested the City to consider designating <br /> the private road, where the trail easement exists, to a public road. When the development was <br /> first brought to Council some concessions were made. The standard road right-of-way is 60 feet, <br /> this development has 34 feet(1 foot on each side of the existing road). The standard setback is <br /> 30 feet,this development's setbacks are between 20 and 23 feet. There is also concerns about <br /> setting a precedent. There are two other developments in this city with private streets that may <br /> request the City to maintain their roads if Ivy Ridge Court/Ivy Ridge Lane were declared public <br /> streets. Also there are concerns that if a new developer came to the City wanting the same road <br /> right-of-way and setbacks as the Wenzel Farms Development it may be difficult for the City to <br /> deny that request. <br /> I met with the members of the Wenzel Farms Townhome Association on April 27. The <br /> following proposal was presented: <br /> The Townhome Association will provide the following: <br /> 1. Sign the additional 8' easement along the southern property line that was approved at the <br /> November 26th, 1996 Council meeting. <br /> 2. Approve a new trail easement along the western boundary of the development. <br /> 3. If necessary, approve construction easement for construction of the bridge. <br />
