D. Withdrawal. If the School District withdraws from this Agreement , the School District shall have no claim to the monetary assets of the City Recreation Budget. ARTICLE V DISPUTE RESOLUTION Section 1. Dispute Process. A. Dispute Process. When ever the City of Lino Lakes feels that there is a misinterpretation or a violation of the specific terms and conditions of this Agreement, they may initiate the dispute resolution process by submitting a written statement outlining the dispute or disagreement. This written statement of dispute shall be forwarded to the School Board at it's regular or special meeting as well as the Lino Lakes City Council. The School Board will then have a three (3) month period to recommend a resolution to the City and School Board to resolve the dispute as to the interpretation or application of the terms of this Agreement. If during the three (3) month period all members cannot mutually agree as to the appropriate interpretation or application of the specific terms of this agreement, the dispute shall be forwarded to the Anoka County Mediation Service or a similarly appropriate mediation service. If the members cannot mutually agree, through the mediation process, within 90 days as to the interpretation or application of a specific term in question, then the Agreement shall terminate as stated in Article IV Section 2. Withdrawal. ARTICLE VI GENERAL PROVISIONS Section 1. All notices required to be given under this Agreement shall be in writing and shall be sufficient if delivered personally or if deposited in the United States First Class mail, postage prepaid, and addressed to either the City Administrator or the School District Superintendent. Section 2. Amendments. This Agreement may be amended from time to time only by writing, signed by both parties. Section 3. Savings Clause. Should any provision of this Agreement be found unlawful, the other provisions of this Agreement shall remain in full force and effect if by doing so the purpose of this Agreement taken as a whole can be made PAGE 4
