son <br />onstruction, Inc. <br />December 12, 1990 <br />Attention: Lino Lakes Staff, City Council & interested persons <br />SUBJECT: Wenzel Farms Addition <br />Hokanson construction has attempted to create a plat on the Wenzel <br />Farms property that would meet all the desires of the City of Lino <br />Lakes and the adjacent property owners. <br />In so doing we were asked to move the road to the west to give the <br />adjacent landowners access to their land to allow them to <br />subdivide. Later, we were told that all the road would be located <br />on our property even though we receive no benefit and would lose <br />eight lots in doing so. In addition, because the road is now <br />located on the property line we are told that we need to sell <br />additional land to the property owners abutting Elm Street. Also, <br />we now have the problem of losing trees whereas our original plan <br />would allow the trees to exist in the rear yards and act as a <br />buffer for the existing residences to the west. To protect the <br />trees, we are now supposed to change the grade of the roads where <br />necessary and show the trees on the survey. <br />We are told that any development must have curvilinear streets even <br />though Sunrise Meadows Addition has few curved streets. By using <br />curvilinear streets our development now has ninety lots versus the <br />one hundred and two originally shown. <br />Park land dedication: The state statutes regarding parkland <br />dedications are explicit. Ten percent is the maximum land area <br />that can be required in a single family development. Trails that <br />are dedicated as a park dedication on the final plat must be <br />included in that ten percent. <br />In summary, our plat is being reduced from 102 lots to 90 lots, we <br />are losing land to put in a road which doesn't benefit us and sell <br />additional land to a neighbor because the road will now be too <br />close to his house, we are to dedicate trails as parks and not have <br />them apply as parkland dedication, we are to have curvilinear <br />streets even though Sunrise Meadows Addition doesn't, and we are to <br />locate and protect our trees from the adjacent road even though we <br />would prefer to put the road where it won't affect the trees. <br />9174 Isanti St. N.E. • Blaine, MN 55434 • (612) 786-3130 <br />
