The aforementioned obstacles that have recently appeared do not <br />include problems that will now be encountered because of the <br />wetland condemnation by the City of Lino Lakes. Prior to the <br />condemnation, we could have rearranged the wetland within the <br />allowances of mitigation and received a nationwide permit to allow <br />some fill. Now we cannot touch it other than for excavation. In <br />addition, because it has been condemned for easement purposes only, <br />the taxes must continue to be paid by the existing owners and we <br />cannot meet the necessary setbacks from it to use the area between <br />the easement and Lake Drive. This does not include the land we <br />cannot use on the south side of the easement which we pay for at <br />the rate of $10,000 an acre - a premium rate given the recession we <br />are now facing. <br />Many of the issues noted above were not addressed when <br />presented our conceptual plat to the City Council. <br />propose that we submit the preliminary plat as approved <br />road being relocated in lieu of park dedication (trails <br />land will still be provided as shown to the Park Board) . <br />issues which appear to be in a state of confusion wil <br />resolved by the City Council at the public hearing <br />direction can then be taken for the final plat.
