CITY OF LINO LAKES <br /> • RESOLUTION NO. 21-86 <br /> RESOLUTION APPROVING AN EXTENSION TO START CONSTRUCTION OF <br /> DISTINCTIVE ELEMENTS TILE AND DESIGN,LLC <br /> WHEREAS, on April 18, 2018,the City Council passed Resolution No. 18-36 approving a <br /> conditional use permit for a Contractor Shop and Office for Distinctive Elements Tile and <br /> Design, LLC; and <br /> WHEREAS,the property is legally described as Lot 1, Block 2,Apollo Business Park No. 2; <br /> and <br /> WHEREAS, Section 1007.016(2)(k) states if construction has not begun within one (1)year <br /> after the date of the conditional use permit, or if substantial construction has not taken place <br /> within three (3) years after the date of issuance of the conditional use permit,the permit is void; <br /> and <br /> WHEREAS, on May 28, 2019,the City Council passed Resolution No. 19-61 granting a 12 <br /> month extension to start construction of the building by April 2020; and <br /> WHEREAS,the applicant was required to start construction of the building by April 2020; <br /> however, due to the COVID-19 pandemic and financial issues, construction has been delayed; <br /> and <br /> • WHEREAS, the applicant is requesting an additional 12 month extension to start construction. <br /> NOW, THEREFORE BE IT RESOLVED The City Council of The City of Lino Lakes <br /> approves an extension to start construction of Distinctive Elements Tile and Design, LLC by <br /> August 31, 2022. <br /> Adopted by the Council of the City of Lino Lakes this 23rd day of August, 2021. <br /> The motion for the adoption of the foregoing resolution was introduced by Councilmember <br /> Cavegn and was duly seconded by Councilmember Stoesz and upon vote being taken thereon, <br /> the following voted in favor thereof: Cavegn, Stoesz, Lyden, Rafferty <br /> The following voted against same: None (Absent-Ruhland) <br /> Rt atferty M� y or <br /> ATTEST: <br /> Bartell, City Jerk <br /> • <br /> 1 <br />
