CITY COUNCIL <br /> IIP AGENDA ITEM 1E <br /> STAFF ORIGINATOR: Katie Larsen, City Planner <br /> MEETING DATE: August 23, 2021 <br /> TOPIC: Consider Resolution No. 21-86 Approving an Extension <br /> to Start Construction of Distinctive Elements Tile and <br /> Design, LLC <br /> VOTE REQUIRED: 3/5 <br /> INTRODUCTION <br /> The applicant, Patrick Bland, is requesting an additional 12 month extension to start <br /> construction of Distinctive Elements Tile and Design, LLC. <br /> BACKGROUND <br /> On April 18, 2018,the City Council passed Resolution No. 18-36 approving a conditional use <br /> permit for a Contractor Shop and Office for Distinctive Elements Tile and Design, LLC. The <br /> commercial building is a 3,024-sq. ft. tile storage area and workshop located on Apollo Drive. <br /> IIPer Section 1007.016 2 , Conditional Use Permits: <br /> (k) If construction has not begun within one (1) year after the date of the conditional <br /> use permit, or if substantial construction has not taken place within three (3) years <br /> after the date of issuance of the conditional use permit, the permit is void. A <br /> conditional use specified in the permit expires if, for any reason, the authorized use <br /> ceases for more than one (1)year. <br /> The applicant was required to start construction of the building by April 2019; however, due to <br /> family and financial issues, construction was delayed. On May 28, 2019,the City Council <br /> passed Resolution No. 19-61 granting a 12 month extension to start construction of the building <br /> by April 2020. Due to the COVID-19 pandemic and financial issues, construction has once <br /> again been delayed. The applicant is requesting an additional 12 month extension to August <br /> 31, 2022 to start construction. <br /> RECOMMENDATION <br /> Staff recommends approval of Resolution No. 21-86 granting an additional 12 month extension <br /> to start construction of Distinctive Elements Tile and Design, LLC. <br /> ATTACHMENTS <br /> lib 1.
