1 <br /> <br />CITY COUNCIL <br />AGENDA ITEM 6B <br /> <br /> <br />STAFF ORIGINATOR: Diane Hankee PE, City Engineer <br /> <br />MEETING DATE: April 12, 2021 <br /> <br />TOPIC: Consider Resolution No. 21-30 Approving Consent to <br />Environmental Covenant and Easement, Lino Lakes Mini Storage <br /> <br />VOTE REQUIRED: 4/5 <br /> <br /> <br />INTRODUCTION <br /> <br />Staff is requesting City Council consideration of Resolution No. 21-30 Approving Consent to <br />Environmental Covenant and Easement document for the Lino Lakes Mini Storage project. <br /> <br />BACKGROUND <br /> <br />On September 10, 2018, the City Council approved the site improvements and Conditional Use <br />Permit for the Lino Lakes Mini Storage project. The project site was identified to have buried <br />debris possibly containing the hazardous materials asbestos and PCB. As a result, the site has <br />been improved under the regulations of the Minnesota Pollution Control Agency (MPCA). A <br />MPCA approved Response Action has been prepared for the site. In addition, the MPCA <br />requires the owner to enter into an Environmental Covenant and Easement Agreement with <br />their agency to maintain environmental restrictions. Restrictions include the land use and a <br />mediation plan if hazardous material is uncovered during construction. <br /> <br />The City of Lino Lakes holds a Drainage and Utility easement over the westerly portion of this <br />site. The restricted area overlaps the City’s easement area and the City is asked to consent to <br />Environment Covenant restriction in the overlapping area. Staff has reviewed the request and <br />supports the Environmental Covenant as it restricts alterations that could lead to contamination <br />and provides a means to address future development of this site. <br /> <br />RECOMMENDATION <br /> <br />Staff is recommending approval of Resolution No. 21-30 Approving Consent to Environmental <br />Covenant and Easement document for the Lino Lakes Mini Storage project. <br /> <br />ATTACHMENTS <br /> <br />1.
