CITY OF LINO LAKES <br />RESOLUTION NO. 21-30 <br /> <br />RESOLUTION APPROVING CONSENT TO ENVIRONMENTAL COVENANT AND <br />EASEMENT, LINO LAKES MINI STORAGE <br /> (440 PARK COURT) <br /> <br /> <br />WHEREAS, on September 10, 2018, the City approved the site improvements and Conditional <br />Use Permit for the Lino Lakes Mini Storage project at 440 Park Ct; and <br /> <br />WHEREAS, the project site was identified to have buried debris possibly containing the <br />hazardous materials, and <br /> <br />WHEREAS, the site has been improved under the regulations of the Minnesota Pollution <br />Control Agency (MPCA). A MPCA approved Response Action has been prepared for the site, <br />and <br /> <br />WHEREAS, the MPCA requires the owner, Lariat Companies, Inc., to enter into an <br />Environmental Covenant and Easement Agreement with their agency to maintain environmental <br />restrictions; and <br /> <br />WHEREAS, the City of Lino Lakes holds a Drainage and Utility easement over the westerly <br />portion of this site. The restricted area overlaps the City’s easement area, and the City is asked to <br />consent to the Environment Covenant restriction in the overlapping area. <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Lino Lakes <br />Consents to the Environmental Covenant and Easement. <br /> <br />Adopted by the Council of the City of Lino Lakes this 12th day of April, 2021. <br /> <br />The motion for the adoption of the foregoing resolution was introduced by Council <br />Member_______________ and was duly seconded by Council Member ________________ and <br />upon vote being taken thereon, the following voted in favor thereof: <br /> <br />The following voted against same: <br /> <br /> <br /> <br />_______________________________ <br />Rob Rafferty, Mayor <br /> <br />ATTEST: <br /> <br />________________________ <br />Julianne Bartell, City Clerk
