<br />7 <br /> <br />Barns, stables and sheds on the property are located more than 300 feet away <br />from the inhabited neighboring dwelling. <br /> <br /> <br />BE IT FURTHER RESOLVED by The City Council of the City of Lino Lakes hereby <br />approves the conditional use permit for commercial stables on the Property with the <br />following conditions: <br /> <br />1. Previously approved Council Resolution No. 20-129, No. 20-130 and No. 20-144 are <br />void and superseded by this resolution. <br />2. The 1968 Special Use Permit for Riding Stable/Show Arena is void and superseded <br />by this resolution. <br />3. The 1997 Conditional Use Permit for BMX Track/Arena is void and superseded by <br />this resolution. <br />4. The Subject Site consists of three (3) parcels (PID #05-31-22-22-0006, #05-31-22-22- <br />0003 and #05-31-22-22-0005). <br />5. The Property consists of two (2) parcels (PID #05-31-22-22-0003 and PID #05-31- <br />22-22-0005). <br />6. If either of the two (2) Property parcels are sold or not held under common <br />ownership, the conditional use permit is void. <br />7. A maximum of 12.5 animal units are allowed on the Subject Site without an approved <br />facility management and waste handling plan. <br />a. If PID# 05-31-22-22-0006 were to be sold or not remain under common <br />ownership, the maximum number of allowed animal units on the Property <br />would be reduced to 10.5. <br />8. A maximum of twenty-five (25.0) animal units are allowed on the Subject Site with <br />an approved facility management and waste handling plan. <br />a. If PID# 05-31-22-22-0006 were to be sold or not remain under common <br />ownership, the maximum number of allowed animal units on the Subject Site <br />would be reduced to 21.0. <br />9. No more than two (2.0) animal units are allowed on PID #05-31-22-22-0006. <br />10. The property owner shall work with the Minnesota Pollution Control Agency <br />(MPCA) in creating an approved facility management and waste handling plan. <br />a. If the facility management and waste handling plan requires off-site storage of <br />manure waste, a written and signed agreement with an off-site property owner <br />shall be submitted to the City annually. <br />i. The agreement shall detail the number of times manure waste will be <br />removed from the site and how much waste will be removed. <br />b. An approved facility management and waste handling plan shall be submitted <br />to the City within six (6) months of Council approval of the conditional use <br />permit. <br />11. The Conditional Use Permit Council resolution shall be recorded against the Property <br />(PID# 05-31-22-22-0003 and PID # 05-31-22-22-0005) by the City. <br />12. The Property shall be in compliance with all City and other regulatory agencies <br />requirements. <br />13. The property owner shall comply with all Rice Creek Watershed District (RCWD) <br />regulations or the Conditional Use Permit (CUP) may be revoked.
