Lyngblomsten at Lino Lakes Addition
Development Agreement
July 26, 2021
page 2
iii. Surfacewater Management Report prepared by Anderson-Johnson
Associates revision date July 14, 2021.
iv. 49 & J Road Concept Layout prepared by SEH dated September 29, 2020
(which shall constitute “Developer Plans” as to roads located within or
directly serving the site only; see also Section 19 with regard to off-site
improvements)

Any provision in the plans or in this Agreement notwithstanding, Developer shall
be responsible for, and the Developer Improvements shall include only, the
construction of the private and public roads located entirely within the platted
property. All roadwork that is located outside of the platted property (the
“County Road Work”) will be secured, paid for, and completed pursuant to
Section 19 below.

5. Permits. The Developer shall be responsible for securing all site grading and
development approvals and permits from all appropriate Federal, State, Regional and
Local jurisdictions prior to the commencement of site grading or construction and prior
to the City awarding construction contracts for public improvements.
6. Developer Improvements. The Developer shall secure a contractor to install these
improvements, hereinafter referred to as the “Developer Improvements,” which
contractor shall be approved by the City Community Development Director in his/her
reasonable discretion. Weis Builders, Inc. is hereby approved by the City. The cost of
Developer Improvements is as shown on Exhibit C attached hereto. All Developer
Improvements shall require City inspection and approval and, where appropriate, the
approval of any other governmental agency having jurisdiction. Although the provisions
in this Section 6 reference the entire Property, the City and Developer acknowledge that
due to the size of the Property, it is likely that development will occur in one area prior
to in another, even if the entire Property is developed in a single phase. Accordingly,
where applicable, Developer Improvements may be completed in a non-simultaneous
manner. For instance, rough grading may occur on the townhome area, and upon
completion of rough grading of the townhome area, utility installation may occur at the
townhome area, while the senior facility is being rough graded. The City will reasonably
cooperate with the Developer to accommodate efficient construction, consistent with
the preceding two sentences. The Developer shall construct and install at the
Developer's expense the following improvements according to the following terms and
conditions.
a. Site Grading
i. No grading shall commence until all requirements of the Rice Creek
Watershed District (RCWD) have been satisfied.
