Site grading and certified compaction testing for the lot upon which the Cottage <br />Home is to be constructed is completed, and City sewer main, watermain, storm <br />sewer, and gravel base construction of the streets to serve the Cottage Homes <br />are constructed, and installation of private utilities such as gas, electric and <br />telephone have been coordinated with the utility provider, except as provided <br />below. <br />i. Model Homes: Structures may be installed as model homes consistent <br />with City ordinance upon approval of the final plat. A record drawing of <br />the site grading for the model home lots shall be submitted prior to <br />issuance of building permits for the model homes. <br />ii. If any building permits for model homes are issued prior to the <br />completion and acceptance of public improvements, the Developer <br />assumes all liability and costs resulting in delays in completion of public <br />improvements and damage to public improvements caused by the City, <br />the Developer, its contractors, subcontractors, material men, employees, <br />agents or third parties. Any such costs shall be reimbursed from <br />Developer’s escrow <br />Senior Living Building - A building permit shall not be issued for the Senior Living <br />Building (a) until the Lot 1, Block 2 site grading is completed, a grading record plan has <br />been approved by the City and perimeter draintile system is installed, or (b) until the <br />Developer has certified in writing that the Lot 1, Block 2 site grading will be completed <br />and the perimeter draintile system will be installed simultaneously with construction of <br />the building. <br />19. Special Provisions. <br /> <br />a. Developer has entered a Contract for Private Development with the Lino Lakes <br />Economic Development Authority. Developer shall comply with all the <br />requirements of that Agreement, including but not limited to those set forth in <br />Sections 3.9, 4.3, and Exhibits C and D of said Agreement. <br />a. Demolition, Temporary Use and Removal of Existing Structures. <br /> <br />i. The single family residential dwelling located at 275 Ash Street shall be <br />demolished prior to or in conjunction with the commencement of site <br />grading activities. A demolition permit will be required by the City. <br />ii. The structure located at 6013 Hodgson Road shall be demolished prior to <br />or in conjunction with the commencement of site grading activities. A <br />demolition permit will be required by the City. Developer shall be <br />responsible for capping private well in accordance with state <br />requirements.
