The structure at 6011 Hodgson Road may be used temporarily as a sales <br />office during construction for a period no longer than 18 months from <br />the date grading operations commence, provided that the sanitary sewer <br />service is re-routed to new sanitary sewer line. Upon expiration of the 18 <br />month period or relocation of the sales office to the main senior campus <br />building, the structure shall be demolished. A demolition permit will be <br />required by the City. The Developer will be responsible for capping the <br />private well and removing the temporary sanitary sewer service. <br /> <br />b. Per Plan Sheet C1.10, Removals Plan Overall dated July 14, 2021 prepared by <br />Anderson-Johnson Associates, Inc., the overhead power lines along CSAH 49 <br />(Hodgson Road) and CR J (Ash Street) shall be converted to underground utility <br />by the local power company. <br />c. The Development requires turn lane, off-site stormwater and signal <br />improvements along Hodgson Road (County State Aid Highway 49) and County <br />Road J (Ash Street) as generally identified on the Concept Plan dated August 24, <br />2020 prepared by SEH, Inc. subject to approval by Anoka County and Ramsey <br />County, the “Off-Site Improvements,” which the parties anticipate will be <br />constructed by Anoka County in 2023. Developer’s share of the Off-Site <br />Improvements intended to be constructed by Anoka County is $902,000. The <br />Developer shall deposit with the City security in the amount of $1,127,500, <br />which represents 125% of the Developer’s share of the Off-Site Improvements. <br />The security shall be provided in the form of a cash escrow, surety agreement or <br />letter of credit in a form acceptable to the City, each of which may be drawn <br />upon by the City in the event Developer fails to pay the Developer’s share of the <br />Off-Site Improvements within thirty days after invoice therefore. The Developer <br />shall also coordinate and cooperate with Anoka County and Ramsey County in <br />the Counties’ efforts to undertake additional off-site improvements related to <br />the Hodgson Road (County State Aid Highway 49) and County Road J (Ash Street) <br />intersection improvements. Such work shall be completed consistent with the <br />49 & J Road Concept Layout prepared by SEH dated August 24, 2020 <br />It Is understood by the parties hereto that Anoka County may itself undertake <br />the Off-Site Improvements, and that such work may be the subject of an <br />agreement between the County and the City. If the City and Anoka County enter <br />an agreement by which Anoka County proceeds with a project that includes <br />construction of the Off-Site Improvements by the County, the City shall retain <br />the cash escrow portion of security referenced in this paragraph, and the letter <br />of credit or surety agreement shall be returned to the Developer. However, if no <br />County/City Agreement for the construction of the Off-Site Improvements by the <br />County is in place by April 30, 2022 the Developer shall submit final construction <br />plans providing for construction of the Off-Site Improvements by Developer
