<br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />______________________________________________________________________________ <br />(Above Space Reserved for Recording Information) <br /> <br />STORMWATER RE-USE AGREEMENT <br />(Watermark, Lino Lakes, Minnesota) <br /> <br />THIS STORMWATER RE-USE AGREEMENT (this "Agreement") is entered into as of <br />this day of , 2021, by and between the City of Lino Lakes (“City”), a Minnesota <br />municipal corporation, and Lyngblomsten at Lino Lakes, LLC (“Developer”). <br /> <br />RECITALS <br /> <br />A. A surfacewater management system including a Pond ("Pond") have been located <br />on property owned by the Developer and legally described as: <br /> <br /> Outlot A Lyngblomsten at Lino Lakes Addition, Anoka County, Minnesota (the "Outlot). <br /> <br />B. The Pond is encumbered by a public Drainage and Utility easement in favor of the <br />City of Lino Lakes. <br /> <br />C. The Developer is using surfacewater from the Pond to provide irrigation water to <br />the common elements within the Lyngblomsten at Lino Lakes Addition (the "Common <br />Elements") as identified on Exhibit A attached hereto and incorporated herein, including the <br />townhome area, green space and boulevards. <br /> <br />D. A Stormwater Re-Use Distribution System (the "Distribution System"), including <br />without limitation a Stormwater Re-Use Pump and RPZ backflow preventer assembly (the "RPZ <br />and Pump"), have been designed and will be installed by the Developer in locations as generally <br />depicted on Exhibit A attached hereto and incorporated herein, which System , RPZ and Pump will
