<br /> <br />DEVELOPMENT AGREEMENT <br />EARLY SITE WORK/GRADING ONLY <br />Belland Farms <br /> THIS AGREEMENT is made this _____ day of ____________, 2021, by and between the City <br />of Lino Lakes (“City”), a Minnesota municipal corporation, and Rehbein Properties, a Minnesota <br />partnership. (“Developer”). <br />1. Subdivision. Developer received preliminary plat approval from the City by Resolution No. <br />21-115 for a plat known as Belland Farms (“Subdivision”), the legal description is attached <br />here to as Exhibit A. Unless otherwise stated, all terms and conditions of this Agreement <br />relate to work within the Subdivision. <br />2. Grading Approval. The City grants approval to commence with site grading, wetland <br />mitigation and installation of stormwater management facilities (“Developer <br />Improvements”), as provided for in City Code Section 1001.145, contingent upon <br />execution and delivery of this agreement and all required security and documents <br />specified herein. <br /> <br />3. Acceptance of Risk/Final Plat Approval. The Developer recognizes that it is pursuing work <br />under this Agreement prior to obtaining all full and final plat and land use approvals from <br />the City for the Subdivision. The developer accepts the risk that all necessary final <br />approvals for the Subdivision may not be granted by the City. In addition to other rights <br />and remedies that may be available to the City, the City may refuse to approve the final <br />plat if the Developer has breached this Agreement and the breach has not been remedied. <br />Development of subsequent phases may not proceed until Development Agreements for <br />such phases are approved by the City and are fully executed. <br />4. Developer Plans. <br />a. The Developer Improvements shall be developed in accordance with the <br />following Developer Plans, original copies of which are on file with the City <br />Engineer. The Developer Plans may be prepared and revised after entering into <br />this Agreement but must be approved by the City before commencement of any <br />work. If the plans vary from the written terms of this Agreement, this <br />Agreement shall control. <br />b. The Developer Plans as of the date of this Agreement are: <br />i. Belland Farms Preliminary Plat containing 11 sheets, prepared by Carlson <br />McCain dated September 13, 2021, and revised on September 17, 2021.
