3 <br /> <br />Shoreland Management Overlay District <br /> <br />The parcel is located in the Shoreland Management Overlay District of Reshanau Lake. This <br />lake is classified as a Recreational Development Lake and has an 883.77 OHWL elevation. The <br />required setback from the OHWL is 75 feet for sewered lots and the maximum allowed <br />impervious surface area is 30% of the site area. The proposed OHWL setback is 75 feet and <br />the proposed impervious surface area is 30% of the site area. Both shoreland requirements are <br />met. <br /> <br />Floodplain Management <br /> <br />The 2015 DFIRM indicates Zone AE floodplain on the parcel. The FEMA base flood elevation <br />(BFE) is 887. The proposed single family home is positioned on the parcel so that it is in the <br />Zone AE floodplain. The lowest elevation of the proposed single family home is 885, which is <br />described as the assumed grade in the crawl space. <br />Per procedures listed under Section 1103.07(2), it has been determined the parcel is in the <br />Flood Fringe district. The FEMA Flood Map Service Center does not indicate that a regulatory <br />floodway is on the site. Due to the absence of a floodway and the presence of the BFE, the <br />parcel is in the Flood Fringe district. <br />Per Section 1103.06(3)(a) Conditional Uses, any structure that is not elevated on fill or flood <br />proofed in accordance with division (2)(a) Standards for flood fringe permitted uses, of this <br />section, requires a conditional use permit. <br />The proposed single family home does not meet the requirements of (2)(a) Standards for flood <br />fringe permitted uses, which requires that all structures, including accessory structures, must be <br />elevated on fill so that the lowest floor, as defined, is at or above the regulatory flood protection <br />elevation. The finished fill elevation for structures must be no lower than one foot below the <br />regulatory flood protection elevation and the fill must extend at the same elevation at least 15 <br />feet beyond the outside limits of the structure. <br />Per Section 1103.06(4)(f), the Standards for Flood Fringe conditional uses: <br /> <br />(f) Alternative elevation methods other than the use of fill may be utilized to elevate a <br />structure's lowest floor above the regulatory flood protection elevation. These <br />alternative methods may include the use of stilts, pilings, parallel walls, etc., or <br />above-grade, enclosed areas such as crawl spaces or tuck under garages. The base or <br />floor of an enclosed area shall be considered above-grade and not a structure's <br />basement or lowest floor if: <br /> <br />1. The enclosed area is above-grade on at least one side of the structure; <br />The enclosed area is above-grade on at least one side of the structure as the low floor elevation <br />of the home is above-grade. <br />2. It is designed to internally flood and is constructed with flood resistant <br />materials; and <br />The crawl space is designed to internally flood through the use of flood vents and will use <br />materials as outlined in the building code.
