1 <br /> <br />CITY COUNCIL <br />AGENDA ITEM 6B <br /> <br /> <br />STAFF ORIGINATOR: Diane Hankee, City Engineer <br /> <br />MEETING DATE: July 13, 2020 <br /> <br />TOPIC: PUBLIC HEARING: Consider 1st Reading of Ordinance No. <br />04-20, Vacating Elmcrest Avenue <br /> <br />VOTE REQUIRED: 4/5 <br /> <br /> <br />INTRODUCTION <br /> <br />Staff is requesting City Council consideration of Ordinance No. 04-20, Vacating Elmcrest <br />Avenue Street Easement. <br /> <br />BACKGROUND <br /> <br />Laborer’s Training Center (LTC) is located at 2350 Main Street. LTC is currently applying for <br />a Conditional Use Permit to construct an additional building on the lot. The applicant is <br />proposing to construct a 37,284 sf training facility to the east of the existing facility. As part of <br />this work, the applicant is also proposing to expand parking facilities, improve the existing site <br />entrance off of Victor Path, extend water and sanitary services, and install storm sewer and <br />storm water ponds. <br /> <br />The applicant has requested a vacation of a portion of the Elmcrest Avenue street easement on <br />the east side of the property, as shown on the enclosed map. The easement is to remain in place <br />over Victor Path. Portions of this street easement have been previously vacated due to the <br />Victor Gardens project in the City of Hugo. A drainage and utility easement was retained over <br />the previously vacated area. <br /> <br />ANALYSIS <br /> <br />The proposed changes include vacating a portion of the street easement. The developer’s <br />engineer has submitted the proposed easement vacation which was reviewed and approved by <br />City staff. The proposed easement vacation is to accommodate improvements to the site <br />entrance proposed on the LTC lot. An Ordinance is required to vacate the easement and the <br />City Council is to hold public hearings for the vacation. <br /> <br />Section 12.05 of the City Charter requires that the real property of the City cannot be disposed <br />of except by Ordinance. The Ordinance will require two readings, publication, and a waiting <br />period before it is in effect. <br /> <br />RECOMMENDATION <br />
