3 <br /> <br />5. Handicap accessibility on the sidewalks shall be maintained at all times in accordance <br />with the Minnesota State Building/Accessibility Code. <br />6. Rental trucks and rental trailers (e.g. Penske, U Haul, etc.) shall be parked in the <br />parking stalls along CSAH 23/Lake Drive. <br />7. No additional accessory structures (permanent or temporary) shall be allowed without <br />an amendment to the conditional use permit. <br /> <br />aIt should be noted that Sheet A1.1 was revised to the Site Plan prepared by Roshell <br />Engineering, LLC dated December 18, 2018 as required by Resolution No. 17-81. <br /> <br />Outside Services, Sales and Equipment Rental <br /> <br />Outside services, sales and equipment rental are permitted accessory uses in the GB, General <br />Business District. <br /> <br />Per Section 1007.112(7)(f), Outside services, sales, and equipment rental accessory to the <br />principal use and limited in area to twenty-five (25) percent of the gross floor area of the <br />principal building. <br /> <br />o 7,740sf gross floor area of principal building x 25% = 1,935 sf total allowed <br /> <br />On the approved Site Plan prepared by Roshell Engineering, LLC dated December 18, 2018 an <br />approximate 1,400 sf “Equipment Display Area” to the west of the building was designated. It <br />was staff’s understanding this would be the only location rental equipment would be stored. <br /> <br />It should also be noted that open and outdoor storage is not allowed in business zoning districts. <br />It is only allowed in industrial districts with an approved conditional use permit. <br /> <br />Project Closeout and Conditional Use Permit Compliance <br /> <br />The applicant recently requested closeout of the project. Staff noted the current outdoor <br />storage of rental equipment and other items were not compliant with the approved conditional <br />use permits. The applicant misunderstood the outdoor services, sales and equipment rental <br />requirements and needs the ability to store rental equipment in the rear yard. Equipment and <br />items have been stored outside on site dating as far back as 2005 as seen on aerial maps. <br /> <br />Staff proposes amending the conditional use permits to allow for outdoor storage of only items <br />related to outside services, sales and equipment rental accessory to the principal use. These <br />storage areas are shown on the revised Site Plan prepared by All Seasons Rental dated June 25, <br />2020. <br /> <br />Staff recommends using the conditional use permit criteria of the City’s LI, Light Industrial <br />Zoning District (Section 1007.120(9)(e) as a baseline for the proposed outdoor rental <br />equipment storage area. <br /> <br />(e) Open and outdoor storage (not outdoor sales lots) as an accessory use provided <br />that: <br />
