4 <br /> <br />1. The designated storage area shall comply with all building setback <br />requirements for the district. Outside storage is prohibited between the principal structure and <br />any public right-of-way. <br /> <br />The proposed outdoor rental equipment storage area meets the 40 ft building setback along <br />CSAH 23 (Lake Drive), 30 ft building setback along Kelly Street, the 35 ft building setback <br />along the east lot line and the 10 ft building setback from the north lot line. <br /> <br />The Equipment Display Area on the west side of the principal building may be used for outside <br />services, sales and equipment rental. <br /> <br />2. The storage area is landscaped and screened from view of adjacent uses and <br />public rights-of-way via a fence and greenbelt planting strip, in accordance with §1007.043 <br />(17)(f) of this Ordinance. <br /> <br />The outdoor rental equipment storage area is screened along the north lot line with a 6ft chain <br />link fence with slats, along the east lot line with a 7ft cedar privacy fence and landscaping and <br />along Kelly Street with the new building and landscaping. <br /> <br />Per Resolution No. 17-81, the security chain link fence with slats along the north lot line shall <br />be replaced with privacy screen fence within 5 years of final plat approval (January 2023). <br /> <br />The outdoor rental equipment storage area is not screened along CSAH 23 (Lake Drive). A 4 ft <br />chain link fence exists. The Planning & Zoning Board recommended a landscape screen along <br />CSAH 23 (Lake Drive). Chain link fences with slats are prohibited for screening. <br /> <br />3. The entire storage area is fenced and secured in an appropriate manner. <br /> <br />The outdoor rental equipment storage area is fenced and secured. <br /> <br />4. The storage area is blacktopped or concrete surfaced, unless an alternative <br />wear-resistant material is determined by the City Engineer to be suitable to control dust and <br />drainage and is specifically approved by the City Council. <br /> <br />Per the Resolution No. 18-03 and the Development Agreement, the rear yard was allowed to <br />use bituminous recycle millings for up to 5 years from final plat approval. The rear yard shall <br />be surfaced with bituminous asphalt or concrete by January 2023. <br /> <br />5. The storage area does not take up parking space or loading space as required <br />for conformity to this Ordinance and is not located in the front yard. <br /> <br />The outdoor rental equipment storage area does not take up parking spaces. <br /> <br />The Equipment Display Area as shown on the revised Site Plan prepared by All Seasons Rental <br />dated June 25, 2020 is allowed to remain. <br /> <br />6. The property shall not abut I-35W or I-35E. <br />
