<br />WS – 5 <br />WORK SESSION STAFF REPORT <br />Work Session Item No. 5 <br /> <br /> <br />Date: April 1, 2019 <br /> To: City Council <br /> <br />From: Jeff Karlson, City Administrator <br /> <br />Re: Garbage Hauling <br /> <br /> <br />Background <br /> <br />Mayor Reinert brought up the idea of limiting the number of garbage hauler lic enses from <br />four to three, which still allows residents to choose their hauler. Section 507.04(1) states <br />that the City reserves the right to limit the number of licenses to four (initially five were <br />issued). <br /> <br />Mayor Reinert would also like to provide a more clear process for suspending or <br />revoking a hauler license when code violations occur. Sections 507.04(5) and 507.05(5) <br />currently state: “The City Council may suspend or revoke the license of any hauling <br />company whose conduct is found to be in violation of the provisions of this chapter.” <br /> <br />The mayor provided an example of Chanhassen’s code that adds more clarity: “The city <br />manager may suspend or revoke the license of any person whose conduct is found to be <br />in violation of the provisions of this chapter. . . . Revocation or suspension of a license <br />by the manager shall be preceded by a public hearing conducted in accordance with M.S. <br />§14.57 to §14.69. . . . Any person aggrieved by the decision of the city manager may <br />appeal the decision to the city council by filing written notice with the city clerk within <br />ten days after the manager’s decision.” <br /> <br />Requested Council Direction <br /> <br />This is for Council consideration. <br /> <br />Attachments <br /> <br />Code Section 507.04(1) Residential Solid Waste Collection License <br />Code Section 507.05(5) License Revocation <br /> <br />
