WS – 5
WORK SESSION STAFF REPORT
Work Session Item No. 5

Date: April 1, 2019
To: City Council

From: Jeff Karlson, City Administrator

Re: Garbage Hauling

Background

Mayor Reinert brought up the idea of limiting the number of garbage hauler lic enses from
four to three, which still allows residents to choose their hauler. Section 507.04(1) states
that the City reserves the right to limit the number of licenses to four (initially five were
issued).

Mayor Reinert would also like to provide a more clear process for suspending or
revoking a hauler license when code violations occur. Sections 507.04(5) and 507.05(5)
currently state: “The City Council may suspend or revoke the license of any hauling
company whose conduct is found to be in violation of the provisions of this chapter.”

The mayor provided an example of Chanhassen’s code that adds more clarity: “The city
manager may suspend or revoke the license of any person whose conduct is found to be
in violation of the provisions of this chapter. . . . Revocation or suspension of a license
by the manager shall be preceded by a public hearing conducted in accordance with M.S.
§14.57 to §14.69. . . . Any person aggrieved by the decision of the city manager may
appeal the decision to the city council by filing written notice with the city clerk within
ten days after the manager’s decision.”

Requested Council Direction

This is for Council consideration.

Attachments

Code Section 507.04(1) Residential Solid Waste Collection License
Code Section 507.05(5) License Revocation
