<br />WS – Item 1 <br />WORK SESSION STAFF REPORT <br />Work Session Item No. 1 <br /> <br /> <br />Date: December 6, 2021 <br /> <br />To: City Council <br /> <br />From: Sarah Cotton, City Administrator <br /> <br />Re: Civil Legal Services <br /> <br /> <br />Background <br /> <br />In November of 2018, the City requested proposals for civil legal services and engaged <br />Rupp, Anderson, Squires, & Waldspurger, P.A. as City Attorney. Jay Squires has served <br />as the lead attorney for the City since that time. <br /> <br />Rates for providing services per the RFP and Engagement Letter are as follows: <br /> General Services $160/hr <br /> Litigation $200/hr <br /> 3rd Party Paid Fees $225/hr <br /> <br />Rupp, Anderson, Squires, Waldspurger agreed to hold the rates above for a period of <br />three years, with a mutual commitment to revisit the rates after that time. <br /> <br />The hourly rates have been frozen for the last 3 ½ years. Mr. Squires has proposed an <br />adjustment to the each of the rate categories as follows: <br /> <br /> 2022 - $10/hr increase <br /> 2023 - $5/hr increase <br /> 2024 - $5/hr increase <br /> <br />Based on historical legal service activity levels, staff is not expecting the hourly rate <br />increase proposed above to have an impact on the 2022 budget. <br /> <br />Requested Council Direction <br /> <br />Discuss engaging the services of City Attorney, Jay Squires for an additional 3 years, at <br />the proposed increased rates. <br />
