Please shift the trees <br />farther from the storm pipes. <br />• Floodplain <br />There are no existing floodplains on Belland Farms. <br />• Drainage and Utility Easements <br />Drainage and utility easements are proposed within the site where there is proposed storm <br />sewer and stormwater management facilities, proposed watermain, and proposed sanitary <br />sewer. The applicant is proposing to include Drainage and Utility easements over all of <br />Outlot A. <br />The applicant is dedicating a 60-ft right-of-way for the construction of Rosemary Way. <br />Comments: <br />1. Applicant shall submit a permit or written permission from company that owns the <br />Pipeline Easement stating that they are clear to construct facilities within the <br />easement. Applicant shall also provide proof of ownership over the future right-of-way. <br />We are currently working with FHR on the pipeline easement encroachment <br />agreement. The pipeline depths have been field measured with a vac truck and we <br />are actively coordinating with FHR on the agreement. FHR has provided preliminary <br />approval of the plan. <br />2. At the time of the final plat, applicant to provide a separate document recording atrail <br />easement over the drainage and utility easement along 24th Avenue N. <br />Noted. Easement description sketch included for your review. <br />The proposed trail easement should be shown as a drainage and utility easement on <br />the plats. Applicant to update plat documents. The trail easement shall be recorded <br />as a separate document. <br />2— Resemary Way right of way shall be N—Ai.vid-e. <br />DlaR revised. <br />00 Development Agreement <br />A Development Agreement will be required with the final plat. <br />Noted. <br />00 Grading Agreement <br />A Grading Agreement is not applicable at this time. <br />Developer seeking grading agreement. <br />• Stormwater Maintenance Agreement <br />The stormwater maintenance for public facilities will be covered under the City's <br />Programmatic Stormwater Management Agreement. The applicant will be required to have <br />their own declaration for stormwater maintenance for the private storm sewer. <br />Please confirm if this is required. RCWD does not require it if stormwater pond is in City's <br />programmatic agreement. <br />The City requires a declaration for stormwater maintenance for the private facilities (see <br />attached PDF for example of what is to be covered by the declaration). <br />The pond on Outlot A, the storm sewer in Rosemary Way, and the culvert that crosses <br />Rosemary Way are the only public facilities. <br />Noted.
