Memorandum of Understanding Between <br />Vadnais Lake Area Watershed Management Organization <br />And City of Lino Lakes <br />Whereas, this Memorandum of Understanding ("MOU") is made and entered into by and <br />between the Vadnais Lake Area Watershed Management Organization ("VLAWMO") and the <br />City of Lino Lakes ("City") each acting by and through its duly authorized governing bodies. <br />Whereas, VLAWMO and City mutually desire to undertake the development of a Feasibility <br />Study ("Study") to evaluate long-term storm water management options for the subwatershed <br />north of Lake Amelia; <br />Whereas, Lake Amelia is a natural environment lake, with a watershed area of approximately 754 <br />acres. The lake lies upstream of Wilkinson Lake which is an impaired water. Lake Amelia is <br />also identified as a lake of biological significance by the Minnesota Department of Natural <br />Resources, due to a high -quality colonial waterbird nesting area; <br />Whereas, the private ditch located upstream and north of the lake contains adjacent wetlands <br />which are identified as a proposed component of City's parks, greenways and trail system in the <br />2040 Comprehensive Plan. The private ditch corridor has seen recent flooding due to limited <br />maintenance and failure of private culverts which has raised concerns regarding long term <br />management of the system as development pressure increases upstream; <br />Whereas, the purpose of the Study is to identify a preferred long term water quality and quantity <br />management strategy for the ditch system and to develop alternative concepts for BMP <br />implementation along the corridor that enhances water quality, preserves flood storage and <br />provides a potential recreational and wildlife habitat corridor; and <br />Whereas, the parties wish to clearly define their respective roles in the development and <br />completion of the Study. <br />Now, Therefore, the parties hereby agree to enter into this MOU and to comply with the <br />following processes with respect to completing the Study: <br />1. City Responsibilities. City agrees to do each of the following: <br />a. Contract for the necessary professional services to prepare the Study Report. <br />b. Provide for management and oversight of Study. <br />c. Provide all required notices to affected property owners and others as may be <br />necessary. <br />d. Comply with all applicable legal requirements related to the Study. <br />2. VLAWMO Responsibilities. VLAWMO agrees to do each of the following: <br />a. Subject to the Minnesota Government Data Practices Act and any other applicable <br />legal constraints, provide City the previous reports and data (if any) for the project <br />area and contributing watershed. <br />b.
