MEMORANDUM OF AGREEMENT <br />SHENANDOAH PARK BMP FEASIBILITY STUDY <br />MEMORANDUM OF AGREEMENT ("Agreement") between the Rice Creek Watershed District, 4325 <br />Pheasant Ridge Drive NE, Suite 611, Blaine, Minnesota 55449 and City of Lino Lakes, 600 Town Center <br />Parkway, Lino Lakes, MN 55014. <br />RECITALS <br />WHEREAS, in December 2009, the Rice Creek Watershed District (District), in partnership with the Anoka <br />Conservation District, published the Rice Lake Stormwater Retrofit Assessment (SRA), later revised in <br />January 2010, with the purpose of providing a blueprint to improve stormwater quality and reduce the <br />volume of runoff entering the stormwater system from neighborhoods that contribute to the degradation <br />of Rice Lake; <br />WHEREAS, on September 27, 2013, the U.S. Environmental Protection Agency approved the District's Lino <br />Lakes Chain of Lakes Nutrient Total Maximum Daily Load Study, with the purpose of quantifying the total <br />phosphorus loading reductions needed for Rice Lake, and others, to meet state water quality standards; <br />WHEREAS, the development of content within the SRA included review and input from other partners in <br />the Rice Lake Subwatershed, including the City of Lino Lakes (City); <br />WHEREAS, the SRA includes a project concept for the City's Shenandoah Park, an excerpt of which is <br />incorporated herein at Attachment A, suggesting it as an ideal location to develop a project to improve <br />water quality by reducing total phosphorus loads and runoff rates, and potentially restoring previously <br />drained wetland areas, collectively resulting in improvements to Rice Lake; <br />WHEREAS, the SRA establishes that a feasibility study including additional engineering and modeling is <br />required to analyze potential project concepts, and their respective benefits, for Shenandoah Park (Study); <br />WHEREAS, the Study will provide valuable information should either the City or District pursue external <br />grant funding for a proposed water quality improvement project in Shenandoah Park in the future; <br />WHEREAS, the City desires to proceed with the aforementioned Study to further develop project concepts <br />for Shenandoah Park; and, <br />WHEREAS, the District desires to cooperate with the City by providing cost -share assistance for the Study; <br />THEREFORE, in consideration of mutual promises set forth herein and other good and valuable <br />consideration, the District and the City agree as follows: <br />I. GENERAL SCOPE OF AGREEMENT <br />A. The City agrees to contract for the engineering and modeling work necessary for completion of the <br />Study. The District agrees to provide partial funding and technical support for this effort. <br />
