Both the rezoning and the <br />petition could be scheduled at the same hearing. <br />Mr. Cardinal suggested that the check and petition be turned over to the Council <br />so they can set up the necessary hearings before the Planning & Zoning and Council. Mr. Smith was also inquiring about permits for light industrial and was told byMr. Locher he must state the exact uses for proposed industrial plants and the <br />property rezoned for commercial could be given special use permits for industrial <br />operations. <br />A public hearing was held for Keith Apitz who requested rezoning of 175 ft. alongBirchStreetfromresidentialtocommercialwhichwouldresultinOrdinanceNo. 6T; <br />lengthy legal description on file in Clerk's office). Mr. Locher showed that allthenecessarylegalaffidavitswereinorder. Mr. Apitz stated that at present <br />the only commercial establishment was a shop to repair cars and to sell a few <br />snowmobiles. This is allowed under the present ordinance. <br />Mr. Husnik moved to recommend to the Council to adopt Ordinance No. 6T which would <br />result in rezoning to commercial 175 feet at 525 Birch Street belonging to KeithandJaneApitz, which allows only the present operation of a general service <br />repair shop. He would have to request further permits to add gas pumps at a <br />future date. Seconded by Mr. Kelling. Carried unanimously. <br />A public hearing was held to consider the application by Cecil LaMotte to plat asLaMotte's Third Addition land in Lino Lakes on Centerville Lake (lengthy legaldescriptiononfileintheClerk's office). Mr. Locher showed that all the legal <br />affidavits were in order. <br />Mr. Jerome Segal, Attorney for the St. Paul Water Department, and Mr. Bill <br />Meuwissen from the Water Department were present to contest the boundaries ofMr. LaMotte's plat. Attorney Segal stated that according to the legal descriptionMr. LaMotte's lots were overlapping on land owned by the Water Department alongCentervilleLake. <br />Mr. Locher stated that it is not the Board's duty to measure lot lines, only toseethattheplatfitsintotheoverallplanoftheVillage. It is up to theVillageEngineertoseethatplatsarecorrectasfarasdimensionsareconcerned. Mr. Gotwald had not yet checked this preliminary plat. The plat must also be <br />approved by the County Surveyor. W. Segal wanted to correct the plat before it <br />got to the final stages and also contended that the troubles began with LaMotte'sSecondAddition, of which he had not received a notice of the public hearing. Mr. Cardinal suggested Mr. Segal appear before the Council Monday evening to <br />present the alleged discrepancy of the lot line. <br />Mr. LaMotte had a lengthy explanation of how the disagreement over lot lines began <br />and stated that at one time he had offered to deed 24 3/4 feet along CentervilleLaketotheWaterDepartmentiftheywouldtakedowntheirfence. His offer was <br />rejected by the Water Department. <br />The Board agreed the lot line discrepancy should be worked out by professional <br />men. <br />Ur. Kelling moved to recommend to the Council that they accept the preliminaryplatforLaMotte's Third Addition. Seconded by Mr. Husnik. Carried.
