5. All fees, charges and escrow related to the preliminary or final plat have been paid <br />in full. <br />BE IT FURTHER RESOLVED by the City Council of the City of Lino Lakes hereby <br />approves Watermark 5th Addition PUD Final Plan/Final Plat subject to the following <br />conditions: <br />1. Outlots A, C, and E, Watermark 5th Addition are preserved as permanent Open <br />Space and shall be improved by the Developer in accordance with the approved <br />plans and upon completion and acceptance by the city of such improvements, they <br />shall be owned and maintained by a Homeowner's Association in accordance <br />with an approved Restoration and Management Plan. <br />2. The Watermark HOA clubhouse and related site improvements shall be <br />completed and operating prior to Council approval of Watermark 61h Addition <br />PUD Final Plan/Final Plat. <br />3. Outstanding punch list items from Watermark 1st, 2na, and 3rd Addition shall be <br />finalized prior to Council approval of Watermark 6th Addition PUD Final <br />Plan/Final Plat. <br />BE IT FURTHER RESOLVED by the City Council of the City of Lino Lakes hereby <br />approves Watermark 5th Addition PUD Final Plan/Final Plat subject to the following <br />items being addressed prior to release of final plat mylars: <br />1. The 5th Addition Development Agreement shall be approved by the City Council, <br />executed and recorded against the property. <br />2. Any staff comments requiring revisions to the final plat shall be addressed. <br />3. A draft copy of the Permanent Trail Easement over Outlot G shall be submitted to <br />the City for review and approval. <br />4. The City Attorney shall review the Homeowner's Association (HOA) documents <br />prior to release of the final plat mylars. <br />5. Final Plat: <br />a. Drainage and utility easements shall be dedicated over Outlot C and <br />Outlot E. <br />b. The final plat shall reference U.S. Home, LLC. <br />BE IT FURTHER RESOLVED by the City Council of the City of Lino Lakes hereby <br />approves Watermark 5th Addition PUD Final Plan/Final Plat subject to the following <br />items being addressed prior to issuance of any single family home building permits <br />within the 5th Addition: <br />1. All comments from the City Engineer Letter dated July 6, 2022 shall be <br />addressed. <br />2. All comments from Environmental Coordinator Memo dated July 6, 2022 shall be <br />addressed. <br />3. Copies of the following executed and recorded documents shall be submitted to <br />the City: <br />
