CITY OF LINO LAKES, MINNESOTA <br /> SITE IMPROVEMENT PERFORMANCE AGREEMENT <br /> THIS AGREEMENT made this day of , 2022, is by <br /> and between the City of Lino Lakes, a municipal corporation organized under the laws <br /> of the State of Minnesota, and Ryan Companies (533 South Third Street Suite 100, <br /> Minneapolis, MN 55415) and Rehbein Properties (PO Box 368, Hugo, MN 55038) <br /> ("Developer"). <br /> WHEREAS,the Developer has received approval of a Conditional Use Permit by <br /> Resolution 22-87 and approval of the Site Development Plans, hereinafter called the <br /> "Plans", by the City of Lino Lakes on the 22nd day of August, 2022, and in accordance <br /> with the Plans all of which are made a part hereof by reference. In consideration of such <br /> approval, the Developer, its successors and assigns, does covenant and agree to perform <br /> the work as set forth in the Plans, in the aforesaid approval, and as hereinafter set forth <br /> upon the real estate (hereinafter referred to as "Property") described as follows: <br /> Outlot A, CLEARWATER CREEK BUSINESS CENTER, Anoka County, Minnesota.; <br /> and, <br /> That part of the Southeast Quarter of the Northwest Quarter(SE 1/4 of NW 1/4) of Section <br /> 24, Township 31, Range 22, described as follows, to-wit: Commencing at the Southwest <br /> corner of said Southeast Quarter of Northwest Quarter(SE 1/4 of NW 1/4) of Section 24, <br /> thence running East along the South line of said Southeast Quarter of Northwest Quarter <br /> (SE 1/4 of NW 1/4) a distance of 275 feet;thence running North parallel with the West line <br /> of said Southeast Quarter of Northwest Quarter(SE 1/4 of NW 11/4) a distance of 375 feet; <br /> thence West parallel with the South line of said Southeast Quarter of Northwest Quarter <br /> (SW 1/4 of NW 1/4) a distance of 275 feet to the West line of said Southeast Quarter of <br /> Northwest Quarter (SE 1/4 ofNW 1/4);thence running South along the West line of said <br /> Southeast Quarter of Northwest Quarter(SE 1/4 of NW 1/4) a distance of 375 feet to the <br /> point of beginning; Anoka County, Minnesota. <br /> NOW, THEREFORE, in consideration of the mutual promises of the parties made herein, <br /> IT IS AGREED BY AND BETWEEN THE PARTIES HERETO: <br /> 1. DESIGNATION OF IMPROVEMENTS. <br /> A. Improvements on the project site to be installed at the Developer's <br /> expense by the Developer as hereinafter provided are hereinafter referred <br /> to as "On-site Work". <br /> B.
