0) A homeowners association agreement or other instrument acceptable to the City <br />shall be required to ensure that the private street remains "private" in perpetuity. Such instrument <br />shall require mandatory participation of all homeowners that have access via the private street <br />and shall include the requirement for creation of a fund to address maintenance, snow removal, <br />and future reconstruction of the private street in accord with City General Specifications and <br />Standard Detail Plates. A copy of such instrument shall be filed with the City as a matter of <br />public record. <br />139 <br />
