CITY COUNCIL <br />AGENDA ITEM 6D <br />STAFF ORIGINATOR: Michael Grochala, Community Development Director <br />MEETING DATE: December 12, 2022 <br />TOPIC: Consider 1st Reading of Ordinance 10-22, Amending City Code <br />Chapter 1011, Stormwater, Erosion and Sediment Control <br />VOTE REQUIRED: 3/5 <br />INTRODUCTION <br />Staff is requesting City Council consideration to amend City Code Chapter 1011 relating to <br />Stormwater, Erosion and Sediment Control requirements. <br />BACKGROUND <br />City Code section 1011 regulates development activities that disturbs land and generates the <br />need for storm water management. The City is required to adopt an ordinance consistent with <br />the requirements of the State's General Permit to operate a municipal separate storm sewer <br />system (MS4). The City was issued a new permit in October of 2021. Additionally, the City is <br />required to be in conformance with the rules and requirements of the local water management <br />organizations (WMO's) — the Rice Creek Watershed District (RCWD) and Vadnais Lakes <br />Water Management Organization. <br />The proposed ordinance amendment is to bring our code requirements into conformance with <br />the permit and WMO' S standards and simplify administration of the code. <br />The RCWD covers the majority of the city with VLAWMO jurisdiction limited to a few <br />hundred acres in the southeast portion of the City. For purpose of applying requirements <br />uniformly the ordinance adopts the stormwater management requirements of the RCWD. <br />New language is shown as underlined text and deleted text is shown with a stfikethr-,,,,g <br />ANALYSIS <br />Sections 1011.001 through 1011.005: <br />These sections were modified to remove superfluous language and recognize the adoption of <br />certain code amendments by reference to RCWD or VLAWMO rules <br />Section 1011.006 Definitions: <br />The definition section was amended to update definitions for consistency with WMO's and the <br />MS4 permit, and delete unnecessary terminology. <br />
